I know nothing about directives, it just appears common sense to me that if you want particular conditions to be included in the assessment, then it is up to you to provide the evidence of those conditions. The DWP are not mind readers.
Problem is that with medical problems people are largely reliant on 3rd party to supply details. That 3rd party is under no obligation to do so.
Providing proof of age to get pension for example... well people will have a birth certificate... or are entitled to get one.
For JSA the claimant will have primary access to evidence to support their claim they're seeking work. (e.g. copies of applications, rejection letters etc).
Similarly to prove things like proof of savings. People are entitled to have details of their accounts and thus will readily have them available.
But getting evidence that you suffer x,y,z with disabling effects a,b,c is quite different. It firstly depends on seeking such assistance. It secondly depends on the services being available.. and available in timely manner. And thirdly it will often depend on medical professionals going above and beyond their duty. My battle with regards getting DLA is precisely because I lack for medical evidence. The reason I lack for medical evidence is because I can't force a medical professional to provide it. That said, my primary problem is I can't get access to a medical professional who would be suitable to provide it. As I'm declared untreatable there is only my GP that is ever likely to provide medically supportive evidence for sickness benefits claims - problem is that it is surgery policy not to engage in patient's benefit claims except where contractually obliged.
Sickness benefits are far too reliant on the expectation that claimants will be seeking and getting appropriate NHS support and that those involved in that have the inclination and time to understand their issues in relation to benefit claims.. and perhaps even understand the benefits themselves... and supply meaningful written information. I'm getting no more medical support than any healthy person... no drugs.. no treatment. I'm awaiting.. and have been since winter... for an appointment that the hospital has tried to cancel.. the only reason I want the appointment is because I'm hoping to get some support for a new DLA claim... it's a long shot..lol.. they clearly want me off the books... to just go away... the psychiatrist who ordered the appointment to discuss potential new treatment options left his post and mysteriously the next week the hospital tried to convince my GP that the appointment I was waiting for should be cancelled as I have personality disorders that can't be treated.

The Civil Service was set-up to impartially carry out the work of the government. It seems like the DWP are doing exactly what the government want them to do. It's you that seems to think the Civil Servants should go above and beyond and try to work against the government by ignoring diktats.Sorry to have to say this but you do sound like the typical DWP employee, over stretched, under paid and has lost the ethos of what the Civil Service was set up to do.
Claimants have a clear job to do when they make a claim.
DWP have a clear job to do as well - when they get it wrong they get slaughtered and slandered.
Time claimants got a does of reality and helped themselves out instead of expecting their job to be done for them.0 -
Just to briefly return to the point of the original post for information as much as anything - if anyone does have any issues completing any Jobcentre Plus adminstered benefits forms - ie because of a health condition/dyslexia etc, you may be able to request an appointment with an advisor at the Jobcentre through Accessing Jobcentre Customer Services (known as AJCS) who can assist you with completing the application form.0
