Bought from B&Q - supplier gone bust

Hi,
I bought (in store) some flooring for home delivery when it was a 4 for 3 special offer price. i now find that B&Qs supplier of this floor have gone into administration. I was told to get a refund. But i want a floor, so i've looked on the b&q website and they have something very similar, the exact same price, but a different code. I've asked that i'd like this floor instead at the same price.

They have said no, but have offered 15% off instead - that is still more than the original amount.

Don't they have to offer and alternative at the same price, or a full refund?

    If B&Q are unable to fulfil your oder then they should offer a refund in full. Did you buy it online? If so you can cancel in accordance with distance selling regulations.

    What remedies have they actually offered you?

    Forgive me for being brain dead, but, if the other flooring is the exact same price, how has offering a 15% discount made it more than the origional amount still???

    If i bought a sony tv from amazon, and amazon's supplier of sony tvs went bust, they should offer an alternative at the same price or a refund?

    Maybe i'm being greedy, but the reason i bought from b&q was because of the 4 for 3 offer

    No, they are not obliged to offer you a more expensive product at the same price as the cheap one they no longer have in stock. Offering you 15% off is a goodwill gesture on their part and already more than they are obliged to do.

    They should -- out of courtersey if anything.

    Legally though by refunding you in full they are doing nothing wrong i'm afraid.

    The 15% off is also a gesture of goodwill so if you like the alternative accept the offer. Or you could be cheeky and ask for 20% ;)

    Have you asked if any other stores in the area have the same flooring in stock?

    This could turn into a game of brinkmanship, which could result in B&Q witthdrawing their 15% offer. But they might go to 20%. Do you want to play the game?

    I think I would take the offer.

    I think most businesses (if entered into a contract) must offer an alternative at equal or greater value than the origional purchase.
