  • This is a bit of a strange question, but I was wondering if anyone had made a claim against a company / previous work for causing or making their depression worse?

    I had a real breakdown when I worked at my previous employment, mainly caused by new management. 4 of us ended up signed off with stress / depression. I am thinking about suing them for the undue stress and making my depression worse. I have a friend who worked there at the time who is prepared to be a witness to what happened.

    Am a bit worried tho about having to go back over what was the worst time in my life, might be quite upsetting?

    On the other hand I know that if I succeeded, the damages payment would seriously help my debt situation, which I mainly got into when I had to leave that job and take a much lower paid one.

    Sorry, just thinking out loud on here really.

    CAB would be your first port of call, I felt well enough to do something about my situation but it was too late by then as the 3 months had elapsed.

    That is my big worry, whether or not I am up to dealing with the claim, but I really don't want them to get away with it.

    Limitation for these claims is 3 years, not 3 months.

    Arrggghhhh. Have so much going on in my head. I need to take a few deep breaths and tackle one thing at a time.

    Am trying to sort our finances out. Was sort of hoping that we might not have to go bankrupt, but don't know really. Situ is, since our IVA failed, we are only being chased by 4 of the companies that we owe money to. So I thought maybe we could try to pay off those 4 companies and we would be alright? Not sure tho. Someone on DFW board said it is not a good idea, as the other companies could start chasing us as well, then we would have to go BR anyway.

    Also thinking about suing my old employer for stress claim and have started looking at solicitors to take the case on maybe. That is bringing back some quite horrid memories.

    And I really need to clean my living room.

    And I have physio this afternoon and haven't really been doing my exercises the last couple of days.

    And I have weight watchers this evening and, although I have been good all week, have just been on my own scales and they say I haven't lost any weight. Argghhhhh:eek:

    No, too much going on in head. Make it stop please.

    Whoa there hun! Time for you to screech to a halt for a moment flissy. :onod.gif Ok hun, you've got the right idea with the above sentence - little steps.;) I know how badly you want to make everything right sweetheart.     As far as the financial side of things hun, I'd probably tend to agree with the advice you've been given. You could pay off the 4 companies angel and then find another 4 will have been encouraged by this and then take their places. The DFW board is great - see what the general consensus is later on maybe, when people are home from work and may post a reply.
    I'd suggest a visit to CAB for this angel - just to be sure. Or go online to them at www.adviceguide.og.uk, which is their information site.

    I'm not surprised you feel like that hun - you're panicking over everything. Don't beat yourself up hunnie.;)

    1. Physio exercises can be restarted. Solved.

    2. Cleaning your living room could be a good distraction and slow your mind down a little hun. Or maybe you could do it with OH or OH could do it while you're out tonight?
    Angel, the state of your living room is not a problem - it's an opinion.;) It will get cleaned. Solved.

    3. Scale-watching is a once a week job hun. Scales can vary. You started your diet last week angel at a ripping pace and as you were told, you're not going to lose that each week. The ideal is apparently about 2lbs a week and whereas that schedules me to be a size 10 when I'm 60 :eek: , the point is that you will get there.;) :T
    If you haven't lost this week, what can you do hun?:confused: Worrying will discourage you. Look forwards to the new week angel.;) Kinda solved.

    4. Your ex-employers. Nothing will be resolved today with that flissy. It may be that you could sue for constructive dismissal (where they made your job such a misery, you had no option than to resign) but you need to see CAB or make some phone calls to a solicitor hun for professional advice. Either way hun, it's going to probably take a couple of years to follow that route. Possibly solved long term.

    I think you are over-stressed by your finances.
    You're naturally looking for the best solution. But you're going over and over it in an attempt to avoid bankruptcy, which is admirable.
    But it's just going around and around in your head and when we think like that over something, we try and find something easier to solve, to try and feel better. And 9/10 imho, all that does is focus your mind on all of your problems, both big and small, and they all end up in an impossible knot.

    With all you have on angel, maybe you'll get more peace of mind in going ahead with the bankruptcy. Your advisors obviously feel this is your best option hun. Keep it separate in your mind from everything else. Any legal action can still go ahead and benefit your quality of life later on. People do survive bankruptcy angel - it's not forever. :o;)

    I know how worried and anxious you are hun and that you've got a lot on your plate.:o But sometimes this kind of situation allows us to sort the big stuff from the little stuff.
    You're a lovely person flis and I'm sorry if I sound like I'm lecturing - I'm not hun. I just don't want you to torture yourself over things. I know from my own experiences how things can seem to snowball beyond control when we worry too much.
    More than anything flis, I just want to say that you're not on your own and that a lot of people here care for and respect you.:A You're never on your own angel. Thinking of you hun.hug.gif

    No tbh hun. Theoretically, it may come under an industrial injury if enough harm was done, but that's just a guess. Jump in the phone book tomorrow angel and look in the solicitors section - some offer free phone consultations. Also as I advised contact CAB. Some branches will give you a vague idea over the phone.

    I would say here that the more people you can contact that were in a similar position, the more likely you may be able to prove a point.

    And that's the risk hun. You won't be able to avoid that. However, going through the process (if there is one) may enable you to lay it all to rest. Also, there are support services available to you to help you through that hun if it comes to it.

    No apologies hun.;) I know you're just trying to solve your finances flis. But this would be a long term thing and also it may be better as trying to think of this - if it's possible - as the stepping stone to getting you back on your feet angel.
    Everything probably seems very dark to you now hun but it will change. You've got to look after yourself too angel - nothing is worth your health. Take care hun. Hope this helped a little.hug.gif

    My thought was that you were happiest when you were achieving and doing 100mph (sorry I'm not metric yet!:rolleyes: ) and that's why you try 200% with everything.;)

    Ok Tiff,

    Have taken your advice and calmed down a bit.

    Actually my physio went really well, he is very pleased with how I am progressing and even said I might be able to go back to work in 2 weeks, when my current certificate expires. Yeah!!

    I am allowed to walk at home without my crutches now, which is lovely, but feels wierd. Still have exercises to do tho and have to keep wearing my tubigrip for another week.

    As far as everything else goes. Your right about the whole stress claim thing, not even sure i want to put myself through it. Might leave it for a couple of weeks, until I am a bit calmer about everything else and see how I feel.

    The money thing, well I posted a detailed SOA on DFW and between them and CCCS have decided that bankruptcy may not be the right path for us anyway. It does seem that we may be able to pay off our debts ourselves, if our creditors agree to freeze the interest. Anyway, have written off letters to all our creditors and will wait and see what happens.

    Not sure how Hubby is going to feel about it tho, he was sort of set on the BR thing. This might be a little bit harder, but will be better for us in the long run. Particularly if in a few years we want to get a mortgage or something.

    Anyway, with all this stress I have hardly eaten anything at all today, so hopefully scales will be kind. Will come on and let you all know how I got on when I get back from weight watchers.

  • Good luck PP, no one will expect too much of you, so take it one step at a time, concentrate on the definites, you will have to get up, get showered, ready and dressed for work! We dont want you going in your wedding dress, so obviously you know you will have to have things ready!

    Best way, then just deal with things as they occur, deep breaths and count to 5, ive dealt with this before, how would i deal with it before?
