Fine for not renewing road tax

A bit of a 'nothing' post, but just to say I've heard nothing from the DVLA since I wrote to them a month ago.
I'm sure they're busy with all manner of things, but "we received your letter and are reviewing your case" would at least be courteous. Otherwise I'm going to have to call them to make sure the letter actually arrived. Grrr0 -
hi, just a quick question,
my partners car has been untaxed since end of feb, will she get a fine?0 -

Have they declared SORN?
If not, they need to do it asap, during March, and no fine will be issued then as long as vehicle has not been on road.
Can use their V11 reminder form (online/phone/post office), V5C Registration Certificate (online/phone) or form post form V890 to DVLA (from post office or direct.gov.uk)

I like the original poster forgot to tax my car (moved house, new baby and hence all paper work gone to pot). My wife was driving the car (2months out of date) and was stopped by a local DVLA sting operation. We paid £80 fine, taxed the car and paid the 2 months overdue tax. It was not great timing for the extra expense but it was my fault so just put it down as a bad experience and a reminder to be more organised with road tax.
However what has annoyed me is that they (the DVLA/clampers/police) who were part of the sting made no reference to the second offence of driving an untaxed vehicle, now three months latter I have received a fine from the DVLA for £134 for vehicle being used on a public road whilst unlicensed. I have not seen any reference to this extra fine in this thread and wanted to raise it as a warning to people on a tight budget who may think that it is all over once they pay the £80 fine.
Also the amount seems fairly random, has anyone had any experience in negotiating the amount of this additional fine.

... The more I think about it, the more I think the Government/DVLA's policy is pretty fair... There's something clean and clinical about just crushing offenders cars, bangers or not - without overtly properting. No car tax, no fine payment received, car crushed or sent to breakers. Clinical and fair... For I would have like to see them use an expensive performance car in the video... Also new legislation is apparently in the works to seize cars which aren't SORN but are on private property...
How can destroying £10,000 worth of someone's property possibly be justified in relation to non-payment of £200 worth of tax?
We should organise a citizen's revolt to go to Swansea and crush the DVLA computer, that'll slow the jobsworths down a bit.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -
Are these the rantings of a madman? We're already living in an Orwellian Big Brother society where the Government, Local Authorities, the DVLA, Revenue & Customs, the Police and many other organisations have way too much power and influence over people's lives.

In last few weeks in the news they have crushed 2-3 Porsches & other luxury cars
What a waste of perfectly good cars & the planet's resources.
The DVLA should be prosecuted for waste.

£134 fine

Rang up to pay the £134 fine to find another £80 waiting for me on their system, so I have had to pay the overdue tax fee twice. Once which was generated and sent to my old address and once for when we were stopped. Total fine for overdue tax plus driving unlicensced £294.Which has proved to be quite an expensive oversight0 -
Advice on this variation would be apreciated.
Due to a 'senior moment' (!) I overlooked taxing my car. Six weeks after the due date, it was clamped by staff from a DVLA clamping van. I acted promptly the following morning, paying the one month back tax and taxing for the following 12 months, then paying a further £100 to have the clamp released. The clamp cannot be released until a current tax disc is shown, incidentally. One of the DVLA documents left on the clamped vehicle (INF32) noted that 'There may also be a fine imposed...'. This infers some arbitrary decision being made somewhere.
One week later I have indeed received a demand for an out of court settlement of £77 (not £80 as mentioned in previous emails) for my car 'being used/kept while unlicensed'.
This raises some questions.
If this subsequent fine is arbitrary, what are the criteria which determine whether it be levied or not? There must be properly defined criteria somewhere.
Have I been subject to two penalities for the same offence? No mention of 'not displaying a valid tax disc' in any documents that I have received.
Where did this idea of a £40 fine for a quick settlement come from? Might this not apply in my case? Certainly there is no mention of this in the docuemnts I received.
Just to confuse you all, this happened in Scotland!

So let me get this staight, if my car tax runs out on the 31/01/2009, so long as i tax it before the end of feb i'm ok? I realise that it will of course be renewed from the start of feb when i tax it but i have till the end of feb?
The reason is i just realised mine is due at the end of the month but as a lone parent i always work my money out for the following month and don't have the $200 spare till 22nd feb.
Will my car still be liable for clamping and if i get it clamped were will i stand?
Thanks all
