Claim against Parcel2go courier company?

Thanks everyone.
I am quite satisifed that my contract was with parcel2go and not direct with HDNL.
I know the obvious answer to my predicament is that the £50 liability applies but I'm not after the obvious answer!
I was hoping someone might be able to give me something to go on in terms of getting around this £50 liability limit, as I'm sure there must be some way around it. It doesn't seem right that a courier company can limit their liability by making you pay extra to insure against their or their agents being incompetent.
The majority opinion seems to be that I'm stuck with the £50 though so I'll probably just take that and take my business elsewhere in the future.
I have to say Parcel2go have been totally useless in their handling of this situation from start to finish, I won't bore you with the details but it includes them emailing me on 3 separate occasions confirming my parcel had been located and delivered to me, when in fact it was still well and truely lost!! I suspect HDNL are part of the problem as from all accounts on the internet they seem to be pretty terrible in most departments.

they offer a cheap service
if you require more than that then you pay more
look at Royal Mail
you can have a basic Special delivery service or pay extra and take the compensation level to £2500
the dont 'make' you
but if you want that cover then you need to pay for it0 -

as I mentioned before, to get this £50 limit out of the way you have to prove the incompetence - you have to prove the lack of due care and attention to your delivery - the £50 limit is there for those case where damage or delivery occurs to a shipment - you need to prove it was sufficiently packed, sufficiently labelled and would only have got lost through incompetence.
e.g. a small box is easy to lose a large box less so.
The difficulty you have here is that it comes down to interpretation of the contract, proof of your efforts to ensure successful delivery and the statutory requirements of the courier service to provide recompense.
International deliveries are bound by the warsaw convention of liability, UK deliveries within the domestic market have no statutory liablity regulations I am afraid...
Take £50, chalk it up and invest in the full service direct with the carrier next time...its common for people to get bitten by the setup of these companies and never return...
Stand by my policy, of buy cheap, buy twice unfortunately.0 -

No your just looking for a get out clause, the choice of insurance is there for a reason. If you were sending an item over the £50 limit you should have selected the level of insurance required. The whole point of insurance is to insure against the unexpected!
Like custardy said its not about being positive or negative, its just the facts. The insurance is there to protect you against incompetence as well as other factors. You choose the level of cover and because you skimped on a few quid you will now lose out on a £100 plus.Everyones opinion is the most important.....no wonder nothing is ever agreed on.0 -

Sorry but its not parcel2go's fault here, they offer varying levels of insurance to customers, its upto the customer to select the appropriate level. Also they haven't lost the parcel, the actual courier has, so even if the OP had gone direct and still selected the same level of cover the outcome would be exactly the same. Your example is like trying to blame your local Ford dealer for a fault on your fiesta rather than Ford themselves.Everyones opinion is the most important.....no wonder nothing is ever agreed on.0
