Claim against Parcel2go courier company?

Posts: 5 Forumite
Anyone have any thoughts as to what to do in the following circumstances -
I instructed parcel2go to deliver a large item, which has a value of £240.
Parcel2go accept their courier lost the item and they offered me £50 compensation on the basis I only selected £50 worth of insurance cover when I booked the courier.
I stated the item had a value of £100 when I booked the courier, however, in reality it is worth £240. I have provided parcel2go with proof that the item was worth £240 and parcel2go do not dispute that point.
I am tempted to argue that they are on breach of contract by losing my item and it is not for me to purchase additional insurance to protect myself against their incompetence.
Any thoughts?

what do the terms and conditions say? They may limit their liability in some way.0

If you did not buy the extra insurance then the £50 limit stands
6.7 If we are liable to you for any reason, we shall (subject always to clause 7) only be liable to you up to the following amounts in the following circumstances:
(a) If we lose or damage all of a Consignment we will be liable for a maximum of £50 (£20 for Hermes and HDNL services). If however this maximum figure is greater than the actual value of the Consignment then we shall only be liable for the full value of that Consignment;
(b) If we lose or damage part of a Consignment, the amount of the sum determined under clause 6.5(a) above shall be pro rated down to represent the proportion that the actual value of that part of the Consignment bears to the actual value of the whole Consignment (so, by way of an illustrative example, if the whole Consignment was worth £50 (£20 for Hermes and HDNL services), and we lost or damaged one quarter of it, we would only be liable for 25% of the figure worked out under clause 6.5(a) above, i.e. £12.50);
(c) If we cause you loss or damage arising in any other way, a maximum of £50 (£20 for Hermes and HDNL services) in respect of any Consignment.
If you consider that the potential loss to you caused by the loss or damage of all (or part) of a Consignment would exceed the figures set out above you must arrange separate cover or insurance to cover such potential loss.If you do not do this then we shall not be liable to you for more than the amounts set out above and you shall be responsible for the risks in any amounts not covered through such cover or insurance (or lack of).0 -
why do you think there are levels of compensation if they dont apply?0
-
Aye, IIRC the lower compensation level = cheaper price...
It's not just for items lost, but for items damaged, or say stolen (in the london riots the other day there were pictures of things like DPD courier vans burned out, and delivery vehicles get broken into/stolen on normal days).
It's like RM only offer up to 100x the price of a stamp for basic compensation for letters etc, but if you pay more you can raise that, and if you go Special Delivery it can (from memory) go to £500 or £1000.0 -

£2500 max plus optional consequential loss0 -
someone here recently won in conflict with this maximum £50 due to the courier they used not providing due care of the goods given to them - Im sure it involved a bin...I cant for the life of me find the thread now mind...
In saying that, this is the reason Parcel2go and similar are so checp compared to going direct to the network - you don't have hardly any coverage in case of loss/damage etc.0 -

no you didn't. Pacel2go is a courier comparison type company. You use them and pick your choice of courier through them and that isn't parcel2go.Parcel2go accept their courier lost the item and they offered me £50 compensation on the basis I only selected £50 worth of insurance cover when I booked the courier.

but did you state it was £100 or take out insurance to cover for £100
Seeing as parcel2go didn't deliver or accept a parcel they can't be incompetent. The courier that you chose through their site lost the parcel through their incompetence and not Parcel2go.I am tempted to argue that they are on breach of contract by losing my item and it is not for me to purchase additional insurance to protect myself against their incompetence.
Any thoughts?
You took out £50 worth of insurance, the courier you chose lost the parcel and you got your insurance.0 -

But the contract is between the OP and Parcel2go, NOT with the courier company - the OP pays parcel2go who have an account with the company concerned.
They are not a comparison site, they are responsible for the shipments, indeed, just try and call the courier company direct, they wont speak to anyone but Parcel2go.
The OP did instruct Parcel2go to carry the freight.0 -

a comparison site takes you through to the retailer or service to allow you to buy - e.g. kelkoo is a comparison site, google shopping is a comparison site.
The difference here is parcel2go do not send you to DHL, Yodel or HDNL to do your label and pay your fee, they do the label, they take the payment, they pay the compensation.
Therefore they are responsible for the actions of the company they contract to complete delivery on their behalf.
If parcel2go merely sent you to the DHL or yodel site then you would be spot on, but as its all within the parcel2go site it is them who you are buying the service from.0
