What are my rights regarding phone?

I hope someone can help me. I took out a new contract around 2 months ago with three. To start with the phone was ok. But as the time has gone on it has become a right waste of time. The battery drains within 3 - 4 hours. It crashes regularly. I am constantly getting a communication failure when trying to connect to anything on the internet. The camera regularly stops working. The amount of battery pulls I have had to do I have lost count of. I popped into the three store near my mums (I live nowhere near one and we went to stay with her for a week), and they basically said wasn't their problem, they could send to blackberry but no guarantees they'd do anything.
I don't know what Ts&Cs where on taking this contract out, (or where to find them to look). Just wondered really, do I have any rights to leave the contract (very) early, or even just asking them to change to a better phone? Or do I just have to lump it?

The company which sold you the phone has to do one of repair, exchange or refund. (Unless they can prove the handset is not inherently faulty).
There is no right to cancel the contract or change the model.0 -

It is definitely their problem! They will have to either get the phone repaired or give you a new one of the same model.0

Its a Blackberry Torch, 9800.
Grumbler, Thank you for the link, looks like something that will come in handyy for me for sure.
I will get onto them again and ask them to do something. I had hoped that they would be more willing to help first time round since I am currently paying 4 contracts with them.0
