It is just that on one of the case studies they said that mugging on the street was robbery, but someone else said that robbery is in a shop as opposed to private premises which is burgalary, have I got that right?
No, not entirely. Mugging is probably robbery rather than theft, as it usually involves violence or threat of violence.
Stealing from a shop can be burglary, or plain theft. It depends on whether the person was there as a trespasser or not....much enquiry having been made concerning a gentleman, who had quitted a company where Johnson was, and no information being obtained; at last Johnson observed, that 'he did not care to speak ill of any man behind his back, but he believed the gentleman was an attorney'.0 -
That is what I meant, I may contact the court reporter.
Try the local rag, whatever it is. They might well know....much enquiry having been made concerning a gentleman, who had quitted a company where Johnson was, and no information being obtained; at last Johnson observed, that 'he did not care to speak ill of any man behind his back, but he believed the gentleman was an attorney'.0 -

Thanks! I'm not entirely back - from Devon to Kent, at my parents' place!...much enquiry having been made concerning a gentleman, who had quitted a company where Johnson was, and no information being obtained; at last Johnson observed, that 'he did not care to speak ill of any man behind his back, but he believed the gentleman was an attorney'.0

The BBC has now taken an interest and is reporting that she was of previous good character, never been in trouble.neverdespairgirl wrote: »The reason I say that it's improbable that you'd get a 5 month sentence for a first offence of handling stolen goods with an immediate guilty plea is that it's way outside the sentencing guidelines - and I mean waaaaay outside."It will take, five, 10, 15 years to get back to where we need to be. But it's no longer the individual banks that are in the wrong, it's the banking industry as a whole." - Steven Cooper, head of personal and business banking at Barclays, talking to Martin Lewis0 -

The facts of an individual case aren't secret either, if you mean that. Unless an order is made for a particular reason, which it hasn't been in this case.
I am coming to the conclusion that this was a first offence (if it wasn't it surely would have been mentioned in the judges summing up) and they have taken every opportunity to max out the sentence, that includes adding the riot in as an aggravating factor along with or, soon after, provided a safe haven.
Ironically if she had taken the lot instead of a £10 pair of shorts she would have still been under the £1k so may have avoided the safe haven aggravation
Having said all that is is still difficult to rationalise the five months especially with a guilty plea and considering mitigation.
The starting penalty is 12 weeks with a range of 6 weeks = 18 week maximum.Factors indicating lower culpability 1. Little or no benefit to offender 2. Voluntary restitution to victim Factor indicating lower degree of harm 1. Low value of goods
or route for disposal
How long does it take to make an appeal? I bet it is five months. I need to be convinced that this is justice.'Just think for a moment what a prospect that is. I see no problem with setting high sentences as an example to others. If you don't do the crime you have nothing to worry about. (Generally).0

So would you rather be governed by a bunch of chavs?
No I wouldn't but that is no reason not to expect Cameron/Milliband to actually have some experience/knowledge of how the rest of Society lives including the hardships as well as their aspirations.
To solve Social problems firstly you need to understand why? Do you think Cameron/Milliband and their ilk have any idea why?and I'm sorry to say employing some Tsar to write a report doesn't cut it for me.
Truthful answer please......;)0 -

I grew up on a South London council estate and living the life does not give you much insight as to why some do fine and some are complete !!!!less wrong uns.
It's not about poverty etc, it's about a sense of entitlement and instant gratification, and I must say a sense of victimhood which has been self perpetuated amongst some communities. The only thing that will control much of this recent underclass is fear of consequences of their actions along with a high chance of getting caught.0
