aaaah-fedup parking ticket

Hi out there can anyone help me? My husband received a parking charge notice from excel parking for £60.00. I have sent letters to them stating he was not the driver and that I did not have to disclose who was, as looking on the forum that's what everyone says to do. We now have received a invoice from Roxburghe debt collectors and they have said if we don't pay in 10 days they will pass this on to their solicitor Graham White. The bill now is £142.00. I want to fight this but I am scared they will take my husband to court or give him a bad credit rating. Which I feel is unfair as he has never had anything like this before. What should I do?

    Yes, just ignore these clowns. It won't go to court and no credit rating will be harmed. These individuals are well known on here. "Graham White" (aka Michael David Sobell) is under investigation by the SRA for sending out these meaningless threatening letters.
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?

    They will not take your Husband to court because they will loose and you will be awarded damages, as proven in many many cases.
    A private company can not enforce a penalty upon members of the public, this has been enforced by courts and judges nation wide.
    How to fight back
    First mistake you made and first blow they landed was contacting them you are now on the live bait hook for harassment
    Completely and utterly ignore them and all the fake letters they send from fake debt collectors and fake solicitors writhed with words such as MAY, COULD, THINK ! what do theses words mean, exactly.
    Cease all contact, reject any phone calls you may receive by placing the phone down immediately.
    They will go away eventually and try to scam money from someone else, time is money to scam artists.

    Not only are you right in not having to name the driver but you are breaching data protection by doing so. Unlike the DVLA, you have evidence that the PPC is acting unlawfully in that it is attempting to harass the individual by billing him for more money than was lost by the landowner. Furthermore, you see with your own eyes that this rate is increasing in great chunks with each communication. The legislation is Contract Law, the competent adjudicator is the County Court and hearings at these tribunals are disputes in need of arbitration; they are not cases heard before magistrates leading to criminal offences.

    You have nothing to fear from Roxburghe and it may interest you to know that Graham White is merely another alter-ego of the creten behind Roxburghe. They even send letterrs from the same address which is the following:

    PO Box 342
    Lavender Park road
    West Byfleet
    Surrey
    KT14 6YX

    If you receive anything by TNT post with this address at the back, simply write "REFUSED - RETURN TO SENDER" on the envelope and stuff it back in the letterbox. It should reach them in a few days but will be making its way via Northern Ireland. That is the procedure when letters go back to sender. I too am on the Roxburghe band waggon and I cannot for the life of me believe that they DID send me a letter AFTER I had originally returned their third correspondence (the first two I did send and like you, I refused to name the driver only to receive their rubbish about how the driver is obliged to tell). This cost me two stamps and that is my limit. My last rejection was returned last week and I've had nothing in the post from them this week. Looking good so far, but if they want to play tennis, they can pay both for their serve and my return hit! ;)

    It is nice to see the value of your house going up'' Why ?
    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.

    I wouldnt have given them the letter in the first place. Thats not what everyone says to do. But just the pure hope there could have been a cheque and the disappointment there wasnt makes me feel a little happier. Continue to Ignor do not write back and the scammers will go away

    Show us where on the forum anyone says that?

    We know Martin's Article suggests it but the articles on this site can be old and out of date - and that one is.

    Look how current the forum is - the whole first page updates every single day with new posts! Once you have read the sticky threasds at the top, read a few other people's posts and you will no longer be scared that this scam is going to go anywhere near any Court.
