It was always a loan and that was made clear from the beginning and it was always a loan to both of them. They knew that it was to be repaid. My daughter has set up a direct debit this week to repay me her side of the loan. He knows the amount he owes me but i was just asking advice if I could persue his part of the loan through the small claims if he makes no effort to repay me. Thankyou so much for the replies so far. I dont know anyone who would not help out their child if they were able.0

If there was nothing formal in place then you would have to prove that it was a loan which is not easy to do.
Did you transfer it all to your daughter or transfer half to each? If you transferred it all to your daughter I very much doubt you can pursue someone that she split this money with.Thinking critically since 1996....0 -
I don't think anybody should begrudge op for lending the money tbh. How many people wouldn't help out their own family during difficult times?

It was paid to the lettings agent for a property that was in both their names. The property agent repaid the money to tham by cheque in both their names. He used the repaid deposit to buy a car0

That makes it a little more interesting (and complex). I am not sure how it helps you but at least it rules out the fact you gave it just to your daughter.
Why not go and see a solicitor, lots do free 30 minutes upfront, that should be enough to establish if you have got enough of a paper trail to pursue the money.Thinking critically since 1996....0 -
Can your daughter not pursue him for her half of the deposit, that he used to buy a car with, rather than you going after him, as I imagine that would be easier to prove?
Once your daughter has this, she just pays it back to you, on top of the her which she has already made arrangements to repay.0 -
Four weeks ago they had a falling out and my dd came back to live with me although the relationship continued, she said that his grandmother was causing a lot of stress by interfearing. Throughout this time I have been told that I would get my money back when the tax rebate came through.
Last weekend the bf dumped my dd by text message after 5 years together, she is distraught and I am very angry.
I wrote to him and was very matter of fact giving him a breakdown of the money owed, dividing it into 2 and saying that I wanted his half of the money owed by 1/9/2011.
Perhaps it's worth asking yourself... would you be pursuing this so vehemently and at this moment if they were still together?
