Having said all that, if the paint is different enough that they are now offering a free re-spray I find it inconceivable that a professional car sales place didn't spot it earlier. We are talking about a nearly new golf here, might be different if it was 10 years old

The have Europe's biggest showroom spread over three floors and are main dealers for Ford, Nissan and Mazda, but in any event, if they can't identify significant accident damage on a 10 month old car then they should say so.
Where they get into trouble is telling lies because this adds to the suspicion/widely held belief that car dealers are habitual liars who wouldn't know the truth it it bit them on the bum and will say anything to get a sale0 -
Don't know, I've never had any dealings with them but the fact remains that if they (or any other dealer) tell lies when describing a car then they can rightly expect justified demands for free remedial work and/or refunds0

i would say its a border line breach of description of goods. the question was asked had it been repaired/had an accident, what i would suggest to the OP is HPI check the car for any trueths about accidents if it were insurance claim when it was a lease car, the car should be 1 owner from new, write to previous owner asking for any aditional information regarding the repair (lease company will have record of expenses if they paid for private repair).
weve come accorss this type of question in the past but more concerntrated aroujnd a private sale, buyer buys a car get it home HPI shows cat d or c then come here for advice and many have advised its not as described and SOGA can come into play here this is no different.0 -
As it is only 10 months old it is likely to be ex-hire, early lease return, or a "managers car" - shorthand for bulk purchase from manufacturer or bulk purchase of fleet cars. All of these routes are likely to come from another part of the burgeoning AC group, who I believe are still self-insuring, and in any case, if the car had been damaged in their own ownership it would not show up on HPi. OP is complaining about a defect that was on plain view pre-purchase so the refinish option appears the only realistic, positive outcome.0

when OP says that bodyshop said it was repaired badly i read that as a poor paint match only
many cars look spot on until you point them in direct sunlight and some cars look many different shades in direct sunlight even when they come direct from factory paint shop
supplying dealer has offered to rectify something customer failed to pick up on at POS just like the seller probably wasnt aware either
as said it will have been self insured so clean history on da istory
sold in good faith
no refund

and I'd say that in cases of clear misdescription discovered after three days the choice to reject or accept the offer of remedial work is entirely the buyers.
If that's not the case then I can't see the point in having a misdescription clause in the SOG as I can't see when it could be invoked0 -

i think you will find most cars have had some paint
its called manufacturers bodyshop
most cars have paint on paint once they are out of the factory many is the time i havent dared tell people their brand new cars have had extra work
its not misdcrescription if its only had paint but you seem to be grasping at contorted bodyshells when the OP never said this
you also have to remember that the bodyshop man might have been speaking out of context to keep the customer happy seeing as they will be getting paid from the sales area0
