Machargs - Nearly new car panels repainted.

We purchased a 10 month old vw golf from Machargs in Glasgow on last Wednesday, after asking the usual questions if it had been in any accidents or repaired to which response was no. However after being away for a few days I noticed on Sunday the tailgate and rear bumper were a different shade of paint from the rest of car Machargs bodyshop said it was repaired badly....and offer to repaint. We have rejected car and requested refund. Can anyone advise if they have been in this position and what resolution was...car is metallic, so paint match can be very hard to get.

    No right to reject - lesson learnt about buying ex hire rubbish from Arnold Clark.

    You assume because it's been repaired that it was them who repaired it - you assume wrong and the hire company they bought it from probably didn't tell them anything about any history.
  • ^^ Really useful yeah. The car was not as described, the OP is perfectly right to try and reject, if they succeed then all is good. BS they didn't know the car was resprayed, the dealer buyer (though not always the brightest) would be well accustomed to what a respray look likes.

    The OP inspected the car prior to delivery and accepted delivery - why would they have the right to reject it?

    They may have the right to have them do a better job of the spraying, they do not have a right to reject the vehicle.

As for inspecting it before delivery, that doesn't create a 'sold as seen' situation. Now for the OP, was this an approved used VW? If yes why not flex your 'right' to the no quibble exchange:

    Oh - not a franchised VW dealer if it's Machargs they've bought from, either, so no Approved Used.

    How can the garage be expected to know it's been in an accident if it wasn't them who repaired it?

    I traded in a car that had been smacked and repaired under my ownership - didn't tell them because I wasn't obligated to - if someone asks them "has it ever been in an accident" and they say "no" then would they be able to reject the car when they find the paperwork from the bodyshop in the car?

    I guess as they are the professionals then either they need to inspect it or give an answer along the lines of "we don't know"

    Where they come unstuck is giving wrong answer which then become part of the description. If they don't know then they should say so, then there would be no comeback

    Having said all that, if the paint is different enough that they are now offering a free re-spray I find it inconceivable that a professional car sales place didn't spot it earlier. We are talking about a nearly new golf here, might be different if it was 10 years old
