Council flat dilemma

Hi

Didnt know where to start and someone recommended me this site.

I have been living in a council flat for the last 2 years with my girlfriend, but the last 6 months she has been living at her brothers as we have not been getting on. She let me stay here as I have no where else to go.

But now the council are asking questions where is she etc.

They know I live here as her boyfriend, I pay the rent council tax through my bank, but the flat is in her name.

Now it doesn't look like we will be getting back together and she is letting me stay in the flat.
But we're not sure where we stand with me staying here now.

I have no where else to go if they decide I cant stay here.

Does anyone have any idea of what could happen?

    Why is she at her brother's and you're at her flat? That's what I can't understand. Why can't you move out and she move back in? Can't you just rent somewhere or you go stay with friends or family temporarily?

    Are you named on the council tenancy agreement at all? Are you on any bills or council tax?

    She needs to write to you to ask you to leave. You show this to the council and they might rehouse you.

    She should be living in her flat.

    I'm here because I didnt have anywhere else to go and allthough we dont want to be together she is still very helpful.

    I did look into renting elsewhere, but just cant afford to rent privatelyor I would of done this straight away.

    My name is on all the bills and the council tax

    Do you work? Surely you have something saved from the time you've spent there with cheap rent?

    If you've split up and it's her flat, I don't really think 'I didn't have anywhere else to go' cuts it, I'm afraid. I don't see how that's her problem, or why she should give up her home. Would her brother maybe put you up temporarily so she can at least have her home back?

    The Council will shortly give her notice to quit because she is not living in her flat; she is not entitled to one if she is not living there.

    So either you stay there and both of you get chucked out
    Or you move out, claim LHA is necessary and she moves back in.
    If you've have not made a mistake, you've made nothing

    Have you considered joining the army? It's a good life for a young man on his uppers, and the ladies do like a uniform.
  • Perhaps your ex might be prepared to help you fund somewhere else in exchange for her moving back in and keeping the property?
