    Have you checked whether it has ever been registered to anyone else with the title deeds?

    I feel for you & wish you luck in whatever your after i.e compo, whatever.


    However, I also think you need to calm down. Pursue whatever you want, BUT try to enjoy the home & be happy about it, in case you have to 'live with it'. Try not to let this spoil your enjoyment of your new home.

    Try to see the positives. Everything works, its what you wanted (in size, location,etc). I'm only saying this in case you cant do anything legally???

    I am not sure where you stand legally, however, if the flats in the block are still being advertised for sale it may be worth either threatening the seller with exposure in local media or actually contacting local newspaper etc.

    Also, I think you should speak to an independent lawyer. The one proposed by the developer may not want to rock the boat given that there are more flats on which she can charge fees.

    Its not an over reaction at all, is it?

    If you buy a house, its a home, you want it as you bought it especially when they are lots of thousands of pounds. I have great sympathy for the buyer.

    I suppose we're all different, but can't believe some people say they'd not be upset! Yep, there is financial loss - the mortgage for one, the 'brand new home premium' for another. I'd be going mental and it would definitely take the shine off the flat for me. I really hope you can get some sort of compensation (I'm not usually a 'compo kinda gal' and hate when everyone looks for compensation from anything and everything) but, in this case, I'm absolutely with you. Sue their !!!!!! off.

    I really hope the stress and upset over it all doesn't last long and you can get on with enjoying your new home.

    This is shocking and OP you have all my sympathy.
    Trying to remain free of unsecured debt and build up some savings.

    Have done CeFA and CeMAP exams but no longer regulated.

    it does matter to me. our mortgage broker said we would have had more option in our mortgage choice if he had known so i guess it does affect us financially. however more than that i have the right to get what i paid for. I wanted a new brand new place therefore paying what we did which I wouldn't have if i had know it wasn't new. its the principle as well, they think they can lie and deceive people to get their commission?

    ILW my husband and I certainly don't think we are over reacting. we saved hard for our first place and expect to get what we pay for.

    My solicitor has come back to me saying she was under the impression that it was new and had not been occupied and verifies that there is nothing in the contracts to say it had been.

    thanks hazyjo and iheartbristol - trust me the last thing i wanted to do was to be in this situation. the developer is due to respond to my complaint this morning.

    Errata i gathered the evidence myself and there is quite a lot of it as well so looking forward to hearing how they are going to cover up their lies. guess they just thought that they would not get caught out this way as the lady in the sales office admitted hence her mortification at the state of the appliances.

    we are definitely the first buyers of the property but it had been let out.
