  • Are there not laws on total disclosure in our country?

    I'm sure there were laws passed to stop estate agents ripping people off with decriptions that were "off mark".

    Or am I wrong?

    doing some research at the moment and all indicates that EAs should not knowingly withhold information. our mortgage broker has been helping us with advice etc, btw if anyone is getting a mortgage I would recommend this guy - amazing and very upfront and honest.

    I am not going to let the matter drop, they think that they can get in a cleaner to clean the appliances and that should be fine!

    Also i have evidence - i.e. voice recordings and screen shot of the property when it was being advertised for renting.
  • You need to calm down a bit and work out what it is that you want. Then you need to find out if you can legally get that.

    I would think a contract has been breached, in particular with regard to the fact supporting evidence around the various paperwork they have incorrectly filled in.

    Now, someone else more experience than me will tell you what the potential remedies of that are, but what are your wants? Remember that:

    i) You will be on the Land Registry as the 1st owner from new, therefore you will to everyone else appear the first buyer.
    ii) What financial loss have you therefore suffered. If they want to clean the flat and so on, that takes it back to where it should be. In addition you may have got the blinds and so on 'free' out of this already.
    iii) Even if you decide you have suffered a loss, what remedies can they offer you? Money? A new flat? Buying it back? I think you'll struggle with the last two, maybe you can get some compensation, more so if they cheated on Land Registry paperwork (Government doesn't like being cheated), etc.

    Your right, I am definitely not calm. I want someone to take responsibility for this. Our mortgage was based on the fact that this was a brand new property. Our mortgage broker has confirmed that if a flat had been previously occupied you have more options in the mortgages offered. I parted with my money to get a new flat and they readily took the money all the while knowing that it wasn't.

    Even if it is cleaned etc, its still is a disgrace. Whoever knew about it when they sold it should be sacked.

    im going to sound thick here but what does it matter? does it impact on you financially? if the place was deep cleaned before you moved in would you have been any the wiser? are brand new flats more expensive than one that has been lived in for 2 months? only asking out of curiosity.

    Can you get any compensation and try finding some contract papers where they said the flat is new.
