    i agree with Googlewhacker, plus it would be admitting wrongdoing of some kind so I'd take legal and/or your manager's advice on it before acting on next steps.

    At this point it's proactive management resulting in a 'misunderstanding'. :cool:

    Your advice (though no doubt well intentioned) may actually inflame things I'm afraid .

    It isn't about you, or the OP - the repercussions of that for the company could be escalated further by silly gestures.
    You don't go around offering staff extra holidays and what not for wrongdoings to them.
    The issue gets dealt with the issue and get on with it? Otherwise all the other staff will be asking for the same thing, for whatever reason.
  • TBH all, i feel really bad for the employee in question. I understand NOW that the job centre will divulge the employer but it was done with the best of intentions to gather cv's should the person in question choose to step down. I am on holiday at the moment and have been advised not to go into work by the HR manager to discuss with the employee, so feel a bit helpless. I also obviously feel like i have messed up big time and considering going sick but am concerned as to the consequences of doing that.

    Don't do that - go back in there and deal with it (once your holiday is over). You have been given some good advice above as to how to do so - especially by Pete111 - so put your professional head back on and get on and do it!

    This now has the appearance of an investigation. Have you been advised if this is the case?

    In the event of, i would be extremely cautious of confessing to anything given it appears management may be considering the route to take.

    No nobody has mentioned an investigation, i placed the advert on Monday and it was found out yesterday. I spoke to the HR manager this morning to tell her i would go in and see him today once there was somebody to look after my son, she seemed ok with this. But later texted me to say not to.

    I think that rather than discussing leaving options with the employee it would have been better to have offered him some training to improve his job performance. Or you could have followed the disciplinary procedure and dismissed him/her that way. Stepping down is not the same as resigning - you have asked him to step down from the management role to return to the supervisory role and he was talking to his wife about it - it is not the same as saying here is my month's notice I am resigning. At the moment he is still in post and there is no vacancy.

    Yes, you were quick off the mark to advertise the job when no vacancy exists. Jobcentres always tell candidates where they are being sent - it is never an anonymous option, placing vacancies with agencies is better for anonymity but agencies charge a fee.

    I would look at your own contract to find out what it classes as gross misconduct because your employer could class your situation as gross misconduct as you have taken it upon yourself to advertise a vacancy that doesnt exist. Sorry if this sounds harsh.

    You should be honest about what you have done and why, at the same time perhaps you could offer the aggrieved person more training so that they can perform in their role, maybe you also need some training on people management?
