ParkingEye "fine" - advice!!!

  • Hi,
    I've received a letter from this company requesting money for a fine after overstay at an Aldi Car Park.
    I know there are been posts about this but I was just wondering if the same advice stands about ignoring the letters or has there been any developments in the 'law'.
    Any help would be much appreciated.

    It's not a fine. The same advice stands.

    There has been a recent change in the law. There are now landmark court cases, VCS Parking Control vs. Ronald Ibbotson, S!!!!horpe, 2012, HM Revenue & Customs vs. VCS Parking Control, Lower Tax Tribunal, 2012 and VCS Parking Control vs. HM Revenue & Customs (Appeal), Upper Tax Tribunal, 2012. In these cases, the judges ruled that only the car park owner (not an agent, ie. a private ticketing company) can charge for parking and take alleged offenders to court. The Upper Tax Tribunal is equivalent to the High Court and, therefore, its judgements set legal precedents.
    The acquisition of wealth is no longer the driving force in my life. :)

    This is an old thread. We have thousands, including new ones every day about this scam.

    There have been no new developments, except in the near future, private clamping is about to be banned and PPCs are about to be allowed to bother the registered keeper as well as the driver. Makes no difference really and doesn't apply to your PCN, which is only the driver's to ignore.

    There have also been the landmark Court cases mentioned above which make life very difficult for any PPC thinking of having a rare punt in Small Claims. Most never do any such thing, they just send template threatograms which you can be ready for, and ignore. Then they fizzle out with no effect on your credi rating, no CCJ, nothing. It's just like deleting phishing emails, it's easy, I have ignored two fake PCNs.

    See my signature, click where it says on the breadcrumb trail top of this page (blue small writing >link>chain). You will then see the current thread list about parking - almost all of which talk about this type of scam as there are lots of companies fleecing people in this way with fake PCNs.

    Read the second one 'PPC letters & threats', watch the Watchdog clip and check out the letters to ignore from your fave PPC. Play snap with each letter and tell your friends & family about this con as well.
