ParkingEye "fine" - advice!!!

    Surely the objective is not just to get the charge cancelled, but to actually get rid of the PPCs altogether.

    And how do you propose this is done?

    By writing to the CEO of the supermarkets concerned, of course.

    I notice another post about another supermarket cafe, I wonder how that poster got on.

    got a parking spEye letter ... am I right in ignoring it? really can not afford 110 charge if they got to court and win. thought about writing a letter as per MSE template but I am guessing its better to ignore. I presume they have to a) prove who was in the car before ...I just can not remember lol

    I guess my concern is ... if it goes no court and I lose and pay the £80 + £30 admin, if there anything else bad that happens? CCJ, etc. Or does the company have to win in court and then give me a chance to pay???

    I am not happy about paying, especially as I was in a drive thru lane for part of the period so not parking continually.


    After a CCJ has been registered against you it will then be recorded on your credit file. If you pay the full amount owed under the CCJ within 28 days of it being registered on your credit file then you can apply to have the CCJ removed from your credit file.

    Parking Spy very rarely do court, because they know they won't win if a defence is put in

    But in the unlikely event they take you to court, to get a CCJ:
    1 - They need to win
    2 - You don't pay what the judges orders within 28 days

    After 28 days they can apply for a CCJ to be registered against your file. But it's very very unlikely so don't lose any sleep over the spammers

    I always like to plan for the worse case scenario and "just ignore it" does not help the sceptical minded. OK, I will save 110 squids up overnext 3 months, and if they do not take me to court in 6 months, I is spending it lol

    Saving £110? Hope you get a nice cheap flight to somewhere nice!

    It will not be going on ParkingEye, that is a fact. They can only seek actual losses. If the initial demand was £50 (NOT £80, that came after a deadline), then they need to lay out a list of their own expenses and lost profits from unpaid fees on the day. It is not good enough to simply say "breach of contract meant they owe us this". No that is not so. What they are seeking is redolent of a penalty and this is unlawful.

    But take it from me, a man whose name is known to ParkingEye, they NEVER do court.

    Oh I can answer that. One PPC - can't remember which, they all look the same to me - published some "statistics" on its website. Nowadays they are all aware of the information being spread on these forums and so they advise against taking notice of it (can't think why?!) and this particular company says something to the effect of the following:

    "claiming ignorance of who was driving is not acceptable, the Road Traffic Act (1984 I think) states that it is the owner's responsibility to know at all times who is driving his car."

    So??? Does this mean when the car is stolen? Or even borrowed for a short time by someone with access to keys whilst the driver is asleep or away?

    More to the point - what do these monkeys have to do with the Road Traffic Act? Does it say "motorists will divulge driver details to PPCs"? I bet it doesn't. The act merely requires a keeper to know the ins and outs where there is a legal issue, and that he confirm the details if asked to do so in court - an authority again.
