ParkingEye "fine" - advice!!!

The act merely requires a keeper to know the ins and outs where there is a legal issue, and that he confirm the details if asked to do so in court - an authority again.

    The actual act says the keeper should not allow anyone to use a motor vehicle without third party insurance. It doesn't say you need to keep a record of who was driving.
    My company vehicles had any driver over 25 cover, so anyone over 25 could drive them theoretically. Except in my case as it was a business I kept a log of who was.
    Its similar to a PCN/FPN it makes the keeper responsible, however with a S172 request the keeper can pass the responsibility to the driver! Or if you don't you get nicked for FTF!

    All of this is totally irrelevant to PPC's but as it blows their claim out of the water if they can not name the driver, they try to claim that you need to know/tell them who was driving.

    Regarding a PPC stating you should know who was driving and telling them! Many moons ago we had the BIB stop a lorry on the motorway services, they checked the driver out and as it happens although he had given us an Italian licence he was Albanian so was nicked. We had to recover the lorry from the services. It took us about 3 to 4 hours to send a driver down to pick it up.
    So a week or so later we get a invoice through the post for at the time penalty charge! Wrote back saying take it up with the driver. We then got the usual you should know who was driving and you should tell us.

    Being the first we ever received I done a bit of asking around and was informed I didn't need to tell them! However I fancied a bit of fun plus the name I had for the driver was Italian who didn't exist anyway. So I wrote back saying, yes I can furnish you with the name of the driver, however since this is not a statutory request covered by law. Any work to investigate will need to be carried out on a commercial basis. We estimate that to examine our records and the drivers records for that day in question. To confirm that the vehicle was were you claim it was will take approximately two hours. At our current rate we will require from you payment of £60 plus VAT. Once we receive payment and your payment clears our bank we will endeavour to furnish you with the required details.

    Funnily enough we never heard from them again!!:p

    I wrote to them asking them to identify the driver and they replied saying my appeal had failed...

    What appeal? how can I appeal when I do not know who the driver is; Will phone them tomorrow and ask to speak to John Michell or Managing Director ... chuffed that I was given there office numbers so no hiding behind 0844 numbers... plus i love it when they try to ...

    Parking Spys of all people should realise there are spies everywhere... :D

    I love calling Managing Directors, they get so cross after a while ...

    Why are you bothering though? Surely you are wasting your time and money by calling them? They don't care if you get angry with them, they get it all the time. They only care about money, which is why we just tell people to not pay up, ignore them and spread the word so more people wise up and don't pay.

    I totally understand getting angry and wanting to have some instant retribution, I just don't think it will get you what you want.

    John Mitchell doesnt actually exist.

    They tried to convince me he did...

    However to prove they were lying i rang and spoke to thier HR department advising i was from the tax office and needed to speak to John Mitchell. They advised he didnt work for them lol..

    Just thought i would go one stop further and spoke to their compliance manager asking why they used fake names(he thought i was calling from some official body)

    He stated We no longer use this name on our letters....

    When asked one of their phone monkeys, to speak to John Mitchell he said he was on site visits...I then put it to him this guy didn't exist and why he lied to me.. and why they used fake names, he just laughed and said it was company policy!!!

  • Oh yes they do use Mr Mitchell. He wrote a begging letter to me a couple of weeks ago. Pathetic company.

    You wasted a stamp there.

    The golden rule is don't write to them, don't phone them, don't encourage them. Just ignore them.

    I've had a couple of run-ins with Parking Eye. They go away after the second the third letter when they realise you aren't taking the bait.

    I called them, which did not cost me a penny as I used tghe 01772 number which is free from my phone :) , and they admitted that they have NO EVIDENCE to the identity of the driver.

    Shame really. wouldn't it be awful if I recorded that ;)

    I guess going to court without any evidence would get rather embarrassing in front of a judge ... hmmmm. Now they know I know they have no evidence to help me identify the driver ... even the threat of court action is redundant. can not see them risking that in court. Now I can forget about it and any of further response can be ignored until they can help me identify the driver :)

    Actually, I did not know the Retail eyes automated recognition did not run on video, but only photographs. It seems if the photo they show you does not have an identifiable person, they do not have any other video or photographic evidence . poor guys :)

  • A simple Google search will show that there are so many faults with Parking Eye's ANPR system that it could not be used as reliable evidence in a court case. There are dozens of Parking Eye's muck ups available for everyone to have a laugh at. I posted one on here on a different thread today.
    Still waiting for Parking Eye to send the court summons! Make my day!
