  • well if you sign up to an agreement its no one elses fault but your own...an element of debt and PPI etc etc people need to take a element of responsibility for it.

    secondly how are my posts 'cover'?... please elaborate.

    i was offering advise due to the fact I've ha close dealings with CAG.

    either dont pay it an risk them passing it to a legal firm

    or if you dont want to pay the full 39% you actually signed up to then thats where I said they'll go as far to as 60% settlement
  • I may be wrong but the way I read it, it doesn't sound like they are charging on the previous settled loan but another loan that had not previously been claimed on.

    If it is a new claim and the claims firm have won it then they should have an offer letter from the lender to be able to check against. And they will be recieving the compensation for it.

    If it is the old offer of compensation not a new one, then just write in to them and say, no, this is an old claim and you have had nothing to do with it so are not entitled to any fees.
  • I have recently received a PPI payment and CAG want 39% as a service payment . 2 months ago I received a telephone call from CAG to say I needed to contact the bank concerned as the bank would not supply them with the information . When I contacted the bank they informed me that the claim had been closed due to lack of documentation I then arranged to send the information direct to enable them to open up the claim again and have now come to a satisfactory outcome , I feel CAG has not represented me in this to its full conclusion and think they have not earned the charges they have send to me . also why did the bank refuse them the information if they had my permission to act on my behalf ? do I have a case to refuse to pay ? as I carried out the process to its conclusion ? thoughts please ?

    All a claims company does is send the initial complaint letter in. Some may periodically chase but that is the extent of what you are paying them for. So, they did what you employed them to do.

    Some claims companies have extremely poor reputations and are black listed and in those cases, the firm may prefer to deal direct with the consumer. Or it could be that the authority letter failed to meet the required standard. Or it could be that the bank did notify the claims company and they just ignored it.

    You have a right to complain to CAG but only they can decide if you should pay or not at the first level. If they insist you pay, which is likely as you got a result due to their initial letter, and you still disagree then you can take them to court and let a court decide.

    People who've used unscrupulous claims management companies (CMCs) can now take their complaints to the Legal Ombudsman.

    About 9,000 complaints were made to the Claims Management Regulator about CMCs last year. But the regulator, which is part of the Ministry of Justice, isn't able to look at complaints on an individual basis (see our How To Complain guide).

    However from today, consumers can take complaints about regulated CMCs to the Legal Ombudsman service for free.

    The scheme, which also deals with complaints about legal service providers such as solicitors and law firms, has powers to order compensation, make firms reimburse costs or provide other forms of suitable redress where it finds there has been poor service.

    To use its service you first need to complain to the claims management company involved. It then has eight weeks to respond.

    If it doesn't, or you aren't happy with the response given, you can take your complaint to the ombudsman. Just fill in the form on its website and email it to cmc@legalombudsman.org.uk, or call 0300 555 0333.

    As it's a new scheme consumers can currently submit claims to the Ombudsman for issues going back to 5 October 2010, as long as they first complain to their CMC. This complaint to their CMC could be submitted now, or have been done so in the past.

    However for anyone who complains to their CMC about a problem that occurred from 28 January 2015 onwards, the Ombudsman will only be able to take complaints within six months of someone receiving a final response from the CMC.

    The ombudsman says it also hopes to improve the claims management industry's reputation by monitoring recurring problems and working with firms and the Claims Management Regulator to address underlying causes.

    There are 1,877 CMCs currently registered with the regulator and only these firms are legally allowed to provide regulated claims management services. You can check if a firm is authorised, and therefore covered under the ombudsman's scheme, on the Ministry of Justice website.

    'Don't pay a CMC when you can do it yourself for free'

    MoneySavingExpert.com campaigns manager Wendy Alcock says: "We're pleased to finally see the Legal Ombudsman is now able to take on complaints about CMCs, it's been a long time coming. We'll hopefully now see people who are paying for a service getting the service they deserve.

    "We've heard tale after tale from people who have received poor service from a claims management company (CMC). And when this happens, it's a kick in the teeth – it is supposed to be helping them resolve a problem, not making things worse.

    "However, people need to know that using a CMC is not the only option. There's no need to pay a claims handler and lose 30% of what you're due. It's easy and free to complain yourself."

    There would be a certain delicious irony in the CMCs getting the £550? £850? FOS fee per complaint given how often they have used this to "blackmail" banks into paying out obviously not miss-sold claims - would be delightful if they are going to be charged per case.

    Its not as much - I believe it is £400 although it may only be £200.
