    OP, if my friend owed me £15k and had no intention of paying-up, I'd send them a letter by recorded delivery giving them 28 days to pay or face Court action. This would be followed-up with said Court action in which I would ask for a charge to be placed on her house. That way, you will eventually get your cash when the property is sold. Then I would grass them up.

    they should have been grassed up years ago .. you can still take her to court , she won't know who has told on her

    there is only one action to report her for benefits theft.
    you were advised on the dro board to just go on the insolvency website and put your 'friends' name on and see iff this was the case..

    Dont understand the bit about the data protection thing. I spoke to the dro gave the name and they said no she had not filled for one. I spoke to the solicitor she said was acting for her. All they said was never heard of her. So no data protection breached. the info about the houses owned was info i already knew. But I have since checked it with Land registry cost me 4.00 per house.
    I have been advised to file a creditors petition with the county court.

    This is getting silly now. There is no way these people would discuss someone else's personal financial situation with you. Have you not heard of the data protection act?

    The Insolvency Register is a public document, listing everyone who has ever been bankrupt or used an IVA to pay back their debtor, and people on DROs. Anyone can check that. There is no data protection issue.

    The Registry Trust online lists all County Court Judgement within the last 6 years, another public document.

    It is just possible that the legal firm are acting for this person but are being cagy re the DPA. I certainly could not even tell a caller if a client was or was not on our books.

    i am not sure this is a good idea. You get the CCJ, she fails to pay, you get a charging order and that is useless because the house is in joint names.

    Do you have documentation proving that she owes you this money?

    If so, go for a statutory demand, the outcome of which is bankruptcy. The intiial cost is nil, the case costs more than a CCJ but you will spend more than the BR fees trying to enforce a CCJ with no effect.

    Not really sure what you mean i get the CCJ she doesn't pay. i do not own the property with her or anything. She actually still owns it with her ex from years back. What happened in the past was one of the properties was sold in 2008 for 150k. they still owed approx 80k to the bank. They came to an agreement he took 70k and signed something to say that the house would be transfered into just her name. She started the procedure but ran out of money to finish it off. She then went back to the solicitor who had the paperwork in 2010. they said, or this is what she said they said. that the paperwork signed was now out of date and it required a new signiture off her ex partner to complete. As for a written agreement about the money I borrowed. No it was done on trust. yes i know how stupid. But love can make us stupid.
    i do have emails stating that she intends to pay me back when the house was sold, but it doesn't state how much. i do have a bank statement though showing this money was drawn out
  • You're not getting that back unless she wants to give it to you, as far as evidence is concerned it's a gift. You may JUST be able to get it back if legals take your side of it, but it will be word against word.

    Uh, but the house hasn't been sold, so why would she pay you back under these terms?

    Also, just a small point - if you were her partner, and you were giving her money (lots of money too) how come you didn't tell her to stop claiming income support then? Personally I wouldn't have wanted to get in a situation where I looked to be implicated in benefit fraud.
