  • What I'm not sure I understand is why both of you would walk away and abandon a property with no mortgage on it (i.e. it's not like it was in negative equity and you had to hand keys back to a lender). You are in financial dire straits, have credit card debts and live off benefits, but you ignore a potentially huge source of money. I'm sure that several years ago it wasn't in such a dilapidated condition. Why would he also just walk away from the property/money in it? Makes no sense. If he was that frightening I'd have involved the police or made sure I'd gone round there with some hefty male friends! No man would have kept me from half the equity in a house if I'd had a child to take care of.

    Some men will spite a woman no matter what. He lived there for a while when I left and wrecked the house. Made it unlivable. No kitchen, no bathroom, no carpets, no heating. i was jut glad to be away. Its easy to say about using big men and that kind of thing. But all violence brings surely is more violance. So the question again is how do you sell half of something when you cant track the person who owns the other half, and if you could know that he would just make life as difficult as possible. The police are not now interested because he has not really comitted a crime.

    Is he the father of your child(ren)? Get the CSA involved... they'll find him...

    I think that some of the people on this forum really understand that sometimes in life you are not always dealing with a reasonable man. yes he is the father. as far as I know he doesn't work, he is a drug addict of no real fixed abode. How can i move back into a house that is wrecked basically just walls.
    I don't know what i am going to do yet. Its called being scared. if i do nothing and get caught, will the concequences really be any worse in 6 months time.
    Difficult decisions ahead. in a perfect world yes I would contact housing first thing. But its not a perfect world.

    In 6 months time you'll owe several thousands more money and won't be able to plead ignorance of what you've done.

    You need to contact housing NOW. You already owe what is probably in excess of £30,000 to them as you have been receiving housing benefit when you shouldnt. This is fraud. And the next time you receive it which will probably be this week sometime this will also get added to the debt.

    You have no choice but to move to the other house and start paying back all this money you are not entitled to, and btw it wont go away and you wont be able to appeal it.

    Op, Whilst I sympathise with the situation you found yourself in, you have admitted yourself, that you have failed to be honest with the office who are assisting you to live.

    The property you jointly own should be declared. If you can show that you only own a share, then only that share would be taken into account in the calculation of your Housing Benefit award and only if the capital is over £16,000 would you definitely not qualify for HB / CTB.

    However, I would say that there must be a substantial risk that you are going to get found out if for no other reason that the Council tax section for the borough where the home is based, will be looking at your details and you will get found out.

    I would say that I know that DV can be a very traumatic issue and I don't think many people have made light of it on here. Hb regs say that we can pay on 2 homes for a period of time if you fled your home due to the fear of violence so the system does recognise the difficulty.

    However, as years have passed, the tax payer has supported you and you now need to stand up and be honest.
    I currently manage a Housing Benefit service and have been working in Housing / council tax benefit (as was) since 2001.

    This is all a bit suss to me, if she has a vacant property somewhere, then she will be liable for the council tax on this property, wouldn't they be looking for her to pay this? if she's claiming HB/CTB for her current accommodation wouldn't they have tracked her down by now to get it settled?
