lender did not carry out employment checks...

Hi,

the quick story...

I lied on an application form saying i was working when i wasnt ( i had been made redundant)

The bank definately did not do there full checks as they would of seen the company i wokred for had been liquidated - no employer reference check at all.

I know i was in the wrong, but times where hard.

Would i have any leg to stand on here? oh and this isnt over a grand or 2 - the loan was for 25K which is the max un-secured loan allowed.

    Why don't you seek legal advice? Oh, I know why, because you lied to obtain a loan.... they might take a dim view of that!

    I know this is my fault and i was young stupid and naive - it was to consolidate my debt. The recession messed alot of things up and i wasn't smart enough to deal with it properly.

    Either way - it was still irresponable lending.

    For which they'll get told off.
    It was also out & out fraud, for which you'll get......? I don't know but it won't be a telling off.

    So, your saying because you lied on an application, youwant to know if you can out of the debt because the bank obviously did not do enough due diligence to ensure that you could pay it back?

    When you ring them up to ask them about this, be prepared to have to pay back the full amount of the loan, plus interest and charges out of your prison wages after you get sent down for Fraud!

    All you can do is keep your mouth shut. hope no one notices at the bank (it is still possible the application will be reviewed as part of a credit audit, especially if in arrears) and get the loan repaid.

    Out of interest, what did you need the £25k for?

    No it wasn't, you lied on the application form.

    The lender applied something called trust to the process, and the little bit at the bottom of the form you signed where it says your not telling porky pies.

    If you pursue this, the liklihood is you will at worst get a criminal record for fraud and at best get a fraud marker on your credit file, which will stop you getting any credit easily for a long time.

    If your having trouble repaying, then speak to the lender, but don't be daft and tell them what you have told on here, as you will be in even worse trouble.

    Go see the Citizens advice burea, have a look on the upping your income board on here, as well as lots of the other money managment tips on this site.

    You'll get through it, but you'll have to work hard to do it.

    Remember your not so young and naive now, so do the right thing now, you will feel better about it in the long run.
