Wwyd- re ebay and wedding item

A couple of weeks ago I put some wedding stuff on ebay (things that I brought when I first planned wedding- but decided not to use)
One of those things were balloon weights--
I put on ebay and on the 17th July they sold to a seller with 177 feedback (all postive)
I had to chase payment (sent a few invoices) and they paid at night on the 19th July- I sent on 20th July
I had just recieved an email from them stating-
Hi, I am writing to inform you I received the box but unfortunately there are only 4 balloon weight in good condition the others are broken. Please let me know what to do. Thank you for your consideration.
I answered-
Hi there. I am very surprised to hear this-- the item was in perfect condition- all unused and all in plastic wrappers. I only assume they got damaged on the way to you?
When did you receive the item-- it was posted to you on the 20th July- as the item was sold on 17th July and you paid on the 19th
In what was are they 'damaged'- can you send pictures?
I don't feel I can refund you- as the items were pictured (in the auction)- and sold as new as thats what they were/are.
All I can do is state- that they were sent in perfect conditon- in good packaging (the box- individual parts for them) and plastic wrappers.
If they are damaged then all I can say is they did not leave my house/the post office I sent them from- in anything other than a perfect state.
that is fair isnt it? Am I in my rights not to refund?- i know they left mine in a perfect condition

I once sold a framed picture via eBay that got damaged in transit (Royal Mail) and I refunded the buyer straightaway. I guess it depends how badly you want to avoid negative feedback! That said, I did ask for photos as proof of the damage first.0

I do think its a fair response but as the seller you are responsible for things like this until the item reaches its buyer. Like MsShopper above said, it depends on how badly you want to avoid negative feedback which sorry to say sounds like you will get if the issue isnt resolved and is to their satisfaction. I would make sure you get photos of the damaged ones before considering a refund and maybe you as the seller contact ebay itself and explain the situation and see what their reply will be.

what is their feedback score like? maybe they are the type to buy things and then to get a refund they say things like this??? but then again as the seller i would want the item/s back before i gave a refund

They look perfect to me, That is how I recived mine off a seller off ebay, They look like they were well Packaged, To be honest I have sold a few bits on ebay and I have had someone do that to me, Then 3 weeks later they sold the same said Item that they bought off me as in perfect condition.
After they got a full refund They never sent the Item back.
I would say ask them to take a photo of the items and email it to you. Then ask them to return said Items back to you for a refund Minus the postage.0 -

Yes definetly wait for the picture before you go any further u never know they may be genuine or they maybe trying to pull a fast one.its so annoying when u get a something like this happen.let us know how u get it.also u want a pic of the box (if they dont send one) least then u can see how damaged it is and get onto royal mail (if u used them) and try and claim it back0
