    Thanks, does anyone think I should still attend?? The letter states they are contacting NatWest for more info, I thought once a SD was set aside it all stopped! Could kill the person who owes this money!!

    Check with the court that Capquest have done as they say, if there is any doubt at all or if the court say it could be in the pipeline then turn up prepared with all the details that you need.
    It sometimes happens that DCA's do not pass on information in time to stop the case so it goes ahead undefended and the judge will automatically find against you.
    Credit card debt - NIL
    Home improvement secured loans 30,130/41,000 and 23,156/28,000 End 2027 and 2029
    Mortgage 64,513/100,000 End Nov 2035
    2022 all rolling into new mortgage + extra to finish house. 125,000 End 2036

    They sent another letter received Friday with a copy of the letter they sent to court asking for no costs to be awarded, I called the litigation dept and said ok I agree to you not turning up but they wouldn't discuss the case as I refused to answer date of birth question. She did say that when info received from the bank they would start legal proceedings against me once again!!

    A suggestion... Make a note of every time you have to spend time on this... I would bill in 1/2 hourly increments at your normal hourly rate. (Hourly might be a bit much for a judge to see as fair ;) ).
    Note date and time you have to do anything relating to this - be it typing letter, posts on here, reading answers and everything travelwise for court and ofcourse lost time at work through holiday etc. Present this invoice to them either when they drop it or in court. Make sure you request payment within 30 days or you will have no choice but to start legal proceedings to recover the money *evil grin*

    Remember it is up to THEM to prove you owe the money - they should have ensured you were the correct debtor before starting down this path :)

    If this really isn't your debt, it's going to be funny as hell to see the judge's reaction at Capquest taking you to court.

    Yes it would but as I had just lost a baby I wasn't in the right mind to deal with anything as it was it took 6 weeks to recover from the surgery!!

    Yes and told them again on Friday when they asked for date of birth, as I wouldn't give this info she refused to discuss the case. Honestly this really isn't my debt, I have a common name which doesn't help!!
