... your home won't be counted as capital [to pay care home costs] if any of the following people still live there:
- your husband, wife, civil partner or someone you live with as a partner
- a close relative who is 60 or over, or incapacitated
- one of your children (including adopted children) who is under 18
- your ex-husband, ex-wife, ex-civil partner or ex-partner if they are a single parent
I am not sure whether you fall into any of those categories?
In any case, you cannot sell until you have probate, and if your mother only has a 50% share in the house, there's the other 50% that is held in the will trust. Also, the way the will is worded, are you sure that the house was not 100% in dad's name?
I've no wish to challenge my share.
The house was 50%/50%.0 -

Yes, I am sure that you don't want to challenge the will, but I'm thinking about whether your mother's share of the house really does need to go in care home fees as well as the income she will get under your dad's will trust. This is not a good time to think about this stuff with a clear head.No reliance should be placed on the above! Absolutely none, do you hear?0 -

To put this in perspective, the person who wrote this blog item was the lead counsel who won a $1 billion verdict against ExxonMobile, so I find it creditable personally... but I am no expert in this. There have also, today, been reports in associated press that BP is investigating two abandoned oil fields for oil sheen, which is unconfirmed and may be unrelated.
OTOH BP have denied it all. http://www.chron.com/disp/story.mpl/business/7703686.html
"BP issued a quick and emphatic denial Thursday after reports began circulating on the Internet about new leaks in its Macondo well, source of a massive Gulf of Mexico oil spill last year.
"None of this is true," the British oil giant said in a statement in response to reports it had deployed boats and containment boom to the well site. It noted the well was capped in July of last year, permanently sealed in September, and continues to be monitored.
BP also downplayed speculation that an oily sheen spotted elsewhere in the Gulf late last week was fed by leaks in two of its exploration wells, plugged years ago, in Green Canyon block 504 off the coast of central Louisiana.
BP deployed remotely operated vehicles over the weekend to survey the two wells. One was confirmed to be secure. At the other, samples were taken of "silty water" found near the well head, but preliminary test results showed no trace of oil or natural gas, company spokesman Daren Beaudo said.
Other companies with operations in the area, including Enterprise Products Partners and Shell Oil, also were notified by the Coast Guard about the sheen but found no leaks.
There's no clear evidence the sheen was tied to a leaking wellhead or subsea pipeline, said Cheri Ben-Iesau, commander of Coast Guard District 8 in New Orleans. It could be the result of natural oil seepage on the sea floor, she said.
The Interior Department's Bureau of Ocean Energy Management, Regulation and Enforcement, which regulates the offshore oil and gas industry in federal waters, was still investigating the source of the sheen.

That's a good point. Pastures, I know it has driven you nuts living in that house with both olds because even before the ill one got ill, you felt you didn't have any space and weren't allowed any autonomy. But if you could have it to yourself, would it suit your needs? Has it got the parking, space for hammering, etc that you want, or is it totally unsuitable?
ETA GDB, I'm reasonbly sure Pastures isn't over 60, or incapacitated, or under 18.
It's not mine to live in, it'll be for sale and I'll just keep it secure by staying in it.0 -

I agree that arrangements would probably be better made less publicly. But to get lots of NP together would mean organising something quite a long way in advance, and there will probably never be a perfect time for it. Of course we wouldn't want it to happen before Pastures has got her remaining old settled somewhere and is free to come, but that's not to say that lir can't start thinking about ways and means.
I think I can guess why she is thinking about it. I found that having a lovely time meeting one NP made me much more curious to meet some more.Do you know anyone who's bereaved? Tyre performance in the wet deteriorates rapidly below about 3mm tread - change yours when they get dangerous, not just when they are nearly illegal (1.6mm).
Oh, and wear your seatbelt. My kids are only alive because they were wearing theirs when somebody else was driving in wet weather with worn tyres.0 -
Every time I try to make arrangements to do stuff, things get in the way.0
