I can see why you are having trouble...it is because you are a pr-ickIt is nice to see the value of your house going up'' Why ?
Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
If you are planning to upsize the new house will cost more.
If you are planning to downsize your new house will cost more than it should
If you are trying to buy your first house its almost impossible.0 -
Have to say I agree with lived on this whole matter, why do people get so involved when they have nothing of value to add.
Geoffky you should learn some respect and manners.
theartfullodger, much the same.....grow up.
lived - I for one have had some terrible experience with the PO, and can help re legal support if required as I have taken the next steps with court proceedings against the PO.
Sorry you are going through the same and it does not help when idiots like Geoffky etc just need to fill their time with annoying time wasting messages.0 -
Trebor, if you have good advice for people suffering the impotency of The Property Ombudsman, I'm all ears.lived - I for one have had some terrible experience with the PO, and can help re legal support if required as I have taken the next steps with court proceedings against the PO.
I've had a bad time selling my flat with CONhells. They broke Advertising Standards Authority guidlines with their "Six Week Challenge" promotion, suckered me in with that promotion, did sod-all in those six weeks then refused to let me go to a more reasonably priced agent. In the following weeks they ran up a huge list of problems - though many are lies of the "my word against theirs variety". With a day to go before I switched to a different agent they eventually pulled their thumbs out and found a buyer.
So I've sold the flat, but incurred lots of stress, a loss of hundreds of pounds when a sale fell through as they did not qualify the buyer and in the end am paying about four times the cost a regular agent would have charged.
The PO just shrugged their arms and said it's not for them to make decisions that are a matter for the courts! I have appealed and they have turned down the appeal saying they will not enter into any further correspondence.
So as it stands I'm guessing the CONhells bully boys will threaten me with legal action and I'll have to cough up "without prejudice" and take it to Trading Standards?
Any advice, gratefully received.

Geoffky - I have to say I agree with the others comments on this thread. Why get involved when you don't know what you are talking about. Suggest sticking to subjects you can add value you to, rather than just guess !!
You want to consider the avatar that you have been blessed with in your short time on this forum and consider that it works both ways. What goes around - comes around0 -
zappahey - And what makes you the judge and jury ?
More unrelated messages that don't concern the person in question......boring me now.0 -
Barnum42 - Sorry to hear about your problems with the PO. Have you escalated to the CEO. I would recommend a final letter to him/her and then if still no joy I am afraid court proceedings maybe your only choice. Whilst not trying to teach anyone to suck eggs, you will need to ensure that you have all relevant facts and evidence to support your claims, as courts are also a hard nut to crack at times. If you paid too much for the sellers fees, I would expect these details to have been set out in a contract.......did you sign up to these....? If not then I would only expect you to be paying the generic fee for that agent. Again any promotional contracts or offers need to be evidenced. I think your option of an approach to Trading Standards is a good idea, as anything to pre empt court action will work in your favour, as you will have shown that you have followed all other alternatives before hand. If contractual errors or breaches are obvious a court will see this and compensate accordingly. If under £5000 I would suggest "small claims courts" and expenses are kept to a min with no need for solicitors etc, although the agent may well choose to send one to represent them, so be sure to get all details in order to avoid a professional getting one over on you.
Good luck, and lets hope you win.
If you do I would recommend reporting the agent and the PO to ARLA.

These threads blow where they will. Often everyone ends up learning something. Unfortunately, if the original poster just gets stroppy about not receiving the answer he wants, the scope is reduced, because anyone who knows a bit more is put right off being involved.bitterandtwisted - if you read my question (which is the point here surely) my question asks if anyone has experience of the PO. If you do then great, if you don't then you can't help can you......? So to make this quick and easy have you had any experience with the PO and if so was it good, bad etc and if so maybe share your experience. If not well, you can't comment so no real point it getting involved is there.....?
I thought it was fair comment. Anyone can make fair comment without needing to be Judge or Jury.zappahey - And what makes you the judge and jury ?
More unrelated messages that don't concern the person in question......boring me now.
As for being boring, I'm beginning to see a bdolly minded chump intent on stopping this thread going anywhere because you can't see that it is going where you want it to go. If you were a bit more laid back about it, it could perhaps have arrived eventually.Hi, we’ve had to remove your signature. DvardysShadow - Seems you have no value to add to the orig post either, another bore.....!!0

No judge, no jury here. Merely a suggestion on another approach you might take if you want to get some value from your presence here.
The choice, however, is entirely yours. What goes around - comes around0 -
From Wiki & clearly applying to Lived who is just winding folks up and succeeding?
