The claim will be under CSA1 because that's what there was when they split so it's continued on that. The PWC might not even know that she could end the claim, wait a few weeks and reclaim under CSA2.
In that case he needs to ask her sharpish! I was assuming - yeah I know- that she had refused.

Depends on how he has behaved to her wether if asked she might migrate, if he has been horrible, she might just say dont want to know;)
Also like me a lot of pwc do not know they can migrate to help their nrp, if asked. Some pwc might choose to say hey we can get on for sake of kids now, lets do mutual agreement!!!!!!!!!0 -
Actually thinking about this a bit more, the OP has said there are problems with access and the PWC is putting obstacles in his way regarding seeing his children. He was advised to get legal advice but he said he couldn't afford it.
Now if, as he says, he has absolutely no income it's all his partners (therefore he can't pay maintenance) he would get legal aid to fight for the contact.
If he can't get legal aid it will be because they take his partners CTC into account as household income therefore he does have an income and he can pay maintenance.

You can't honestly expect a NRPP to pay CM for kids that are not hers surely? I'm not saying the op shouldn't be working and paying himself, he clearly should. But a NRPP's wages should never be taken into account to pay CM!0 -

if i get a new partner and he moves in with my children he will be expected to pay towards their upkeep so why should it be any different for NRPs?
they are living together as a couple and share everything. his kids are her step kids. when you get into a relationship with someone with kids you are taking them on too - CM and all!Countdown to Discharge Is On!

If I was a cynical person I'd read this thread and think the OP was doing all he could to avoid paying maintenance:
Giving up his job so he has no income
Having the CTC award in his partner's name and not disclosing the joint claim to CSA (or his partner fraudulently claiming as a single person, it's one or the other)
No bank account
No credit cards of his own just a second card in his partners name
The CSA might have mucked up in the past but you can sort of understand why they think he's deliberately evading maintenance.
I'm curious, has the OP said how long he's been separated from the ex, how long he was paying maintenance for and how long he hasn't been paying?Dum Spiro Spero0 -

Your a loon tune. Take into account the nrpp's wages as income. You need to get a grip. Of course if the nrp partner had say a few kids of their own, i am sure you would agree then that the nrp should actually pay less as there are more kids in the household?.0 -
They will realise what a cheating scumbag their mother is, denied them life's little treats, denied them a paternal family life, denied me the right to work for financial gain, the fraud investigation, how she colluded to drive a wedge between me and the children. That is only OTOH, i can list all day.
Your kids will remember that your hate for their mum was such that it took over your love for them. I am in the opposite situation. My ex provides no maintenance yet sees them every week-end. We even changed contact around his requirements. The fact that he doesn't pay maintenance benefits directly his partner, who doesn't work, and her children. The money that should go towards our children go towards her and her children. I could go to the csa and make it a nightmare for everyone. He would take it on the kids and they would suffer for it. I love my children more than anything and if it means that doing what is best for them means that their dad, step-mother and step-children gain from my position, then so be it. One day, my kids will know the SACRIFICES I accepted to make for them.
Your ex is not responsible for you deciding not to go back to work, nor is she responsible for your relationship with csa. It has nothing to do with her. It is your decision not to work and yours only. It is your battle with the csa, and yours only. Your children will soon see what a bitter, calculating and uncaring father you are and will no doubt want to stay as far away from you as they can.0
