    Although the OP's employee/colleague does not hold a UK licence, for the purposes of the awarding of points he will be treated as though he did. The DVLA will create what could otherwise be described as a "ghost" licence in his name and should he acquire any further points then these will count towards a "totting" ban - if that were ever to become relevant - as nilrem has described.

    As a non-EU driver he will not be eligible for a COFP or a speed awareness course (or equivalent) and if named he is likely to be summonsed. Assuming that he would be likely to plead guilty then he could respectfully suggest to the bench that they consider mirroring the penalty he would have otherwise faced had he been a UK citizen and therefore been eligible for a conditional offer of fixed penalty - i.e. £60 and 3 points.

    If it happens that this member of staff is about to or already has returned to the US then the OP should ensure that he and his company can demonstrate that this staff member exists and was both in the country at the relevant time and that he has genuinely returned. Attempting to illicitly suggest that the driver at the time of an alleged offence was a foreign citizen who has since returned home is, sadly, an all too frequent excuse offered by those attempting to duck their own responsibility. Often, only when they find themselves counting the tiles in the wall at night and being afraid to pick up the soap in the communal showers does it dawn on them that to do so is a serious criminal offence (attempting to pervert the course of justice) for which jail time is guaranteed. Just a word to the wise.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    I'm from the eu and drive a hire car, ?? whats the point??

    From the "USA" equates to being "over here" for those with a long memory. That does not exclude a uk license??????????????????

    How long ago? The scheme with the UK counterpart licence has only been around for about a year I think.

    Not far off. It came in in 2009 and extends just to EU drivers who can apply for a UK counterpart to their EU licence thus allowing them to avail themselves of the fixed penalty system.

    The Aussie system does not carry points in the same way as it does here. In the majority of cases you simply pay a fine and no endorsement is required. It is the endorsement part of the disposition of cases here that causes the problem hence the need for a counterpart licence to carry the mandatory points.

    No but if and when he is dealt with at court and his "licence" is endorsed then the DVLA will create a "ghost" UK licence for him to bear the points - as explained about at post #12.

    They are not legal persons of the EU so are not bonded as you and I to obey primary legislation (offences) they can only be prosecuted for breaking the Law, legislation is not the law, it an act of statute given the force of law by consent, that consent is given by your parents when they register your birth to the crown.
