Chancel Repair Liability

Who pays for the indemnity insurance for chancel repair liability - the vendor or the purchaser?

    Okay that was a bit flippant, but it really does depend on who has the most to lose. There's no hard and fast rule.

    The buyer. I bought 2 houses last year and took Chancel Liability Insurance on both, £25 with successor rights, £14 without. Hardly anything to quibble over.

    I agree in practice.

    In theory if there is any potentially adverse legal matter relating to a property the seller should deal with it.

    So when I did Chancelcheck Searches and they came back with a potential liability I would ask the seller's solicitors and very often they would refuse to pay for them. So I would go back to my client and essentially say that the seller should pay but the cost was only around £60 and did they really want to waste a week or two arguing about it?

    (I don't do the searches now but routinely insure and clients don't begrudge £10-£15 for this.)

    Normally this is organised by solicitors as it is a specialist kind of policy, and insurers would be plagued with lots of extra admin and queries if they dealt with the general public so I doubt if there will be a direct link to the insurer.

  • I recently purchased a house and we got our chancel repair insurance direct from a company called CLS rather than going through our solicitor - it is called ChancelSure. I believe you can also do it over the phone and when I spoke to them they were very helpful!

    looked at Chancelsure, policies starting at £45.88, not the £25 quoted above?? Where can I get the £25 policy? I've had enough of all these insurance requirements!
  • Before we decided to do it ourselves, my solicitor had a look round for me and this was the cheapest we could get it. Don't forget it depends on the size of your property and how many years you want to be covered for. It may say '£25' but this is probably dependent on your requirements.

    Just to clarify my previous post, the 2 policies I took out last year were via my solicitor. I was most surprised when she told me to ignore the prices on the leaflet that came back with the searches and that she dealt with an insurer who sold indemnity policies at the prices I quoted before. I will check the company when I am back home at the weekend if still required.
