Thanks for your replies, i've not heard anything yet from the supermarket chain, but will let you know.
My resolve is wavering slightly. Today (10/7/11) we recieved another Parking Charge Notice to Owner from ParkingEye car park management. In this one, it has two pictures of the car, one coming into the supermarket car park and one coming out.
It also has beside it how many minutes it overstayed which was 16 mins. The PCN is £80 but £50 if payed by 13th Jul, giving over 1 day left to pay.
Can they do that? penalise a disabled woman for all of 16 mins just because she can't get to the car on time because she can't walk fast?
Should she pay it now there is pictures on it?0 -

They most definitely can NOT penalise a disabled person in this way, what they are doing is illegal.
Worth another letter to the supermarket,be sure to tell them they are liable for the actions of their agent and as such it is they who will end up in court if you pursue a claim of discrimination.
Also worth a letter to the local press who love this sort of thing.
PS DO NOT waste your time however writing to Parking Eye.0 -
They can't penalize anyone. They are just trying it on... Find your resolve get it back and refuse to pay. Don't even bother trying to send letters as they wil be more determined to chase you.:footie:

It was because they have pictures (actually on the letter they sent) and evidenital proof that the car was clocked from the moment it came in to the supermarket car park and the moment it came out.
Thats why I was not so sure, it was because they had proof.0 -

What they have is proof that it takes a disabled person longer than a non disabled. Which is EXACTLY why the Equality Act REQUIRES them in LAW to make reasonable adjustments for the disabled.
Included in reasonable adjustments is allowing the disabled extra time, if they ever dared to try and claim in a court they would not only lose , they could find themselves in serious trouble for breaching the Act !!

They do not have proof of a crime.
I could photograph you walking along a street, then send the photos home and tell you to pay me £100. The fact that I have "proof" of you walking along a street does not mean I have proof of you doing anything wrong.
As others have said, they are breaching discrimination laws.
Furthermore, they CANNOT impose a penalty, only sue for damages for breach of contract. Which would top out at the amount not paid pay for the extra time used (e.g. £1 extra). The law is very clear on the issue.0 -

What I would do is send a strong letter of complaint to the Head Office (CEO is best) of each Supermarket, enclosing a printout of the attached article. Point out that it was the relative's legal right to be allowed 'reasonable adjustments' under the Equality Act (DDA as was) and that it is patently obvious that longer parking time is eminently reasonable.
Say you look forward to receiving confirmation that:
- the fake tickets have been cancelled (call them fake tickets deliberately)
- steps are being taken to ensure Equality Act compliance immediately
If not confirmed within 7 days, or if your relative receives any letters about these bogus PCNs you will help them to report the matter to the press, the authorities and to their Solicitor with a view to bringing a case for compensation.
Someone needs to take action about this scam soon. Supermarkets and PPCs are breaking the Equality Act and no-one has brought a legal case about it...yet. Monetary compensation is the remedy for an Equality Act breach and this is IMHO a sure-fire case of disability discrimination.

The Watchdog paper aeroplane episode also featured a fake PCN with pretty picture of a car on it, just like yours.
