A family member recently was sent a Parking Charge Notice from ParkingEye for overstay of 20 mins in a well-known supermarket chain in Glasgow.
The family member never even had any indication that they charged her for this on the day, she only recieved the notice today.

2 days later, after arriving back to the car from going into town (as she cannot drive into Glasgow she has to park on the outskirts), she then got another Parking Charge Notice from CP Plus from the same well-known supermarket chain but in a different area of Glasgow, this was another overstay. It was stuck to her window this time, hand-written notice.

At this point i should tell you she is disabled. She has limited movement and this causes her to be slower than normal, she also needs a person to be with her to hold her when she walks. She was also parked in a disabled space both times, so that should give an indication that the person parked may not be the fittest of people.

I am utterly outraged at these notices, especially given to people in disabled spaces and to people with little money. Does this mean she can't go anywhere now because she will keep on getting charged for her disability?:mad:

I do not know what to do or say to her. Should I tell her just to pay the notices and get it over with or will she ignore these and hope they go away?

I don't know what to do. Help!

    Congratulations, don't bother to go for the third one. You now have twice the pleasure of us ordinary mortals in that you can ignore them twice.

    Both supermarkets should be reported under the Equality Act for not making extra provision for disabled customers.

    No don't pay, she has done nothing wrong and they have no authority to charge her. I would complain to the supermarket on her behalf.

    Is this Aldi?

    esmerobbo, no not Aldi, not sure if i can say much so that it can't come back to me, but in my opinion its the 3rd biggest store chain in the country.

    It matters not if you mention them, however it does not matter as the advice is the same. I mentioned Aldi as they seem to have the shortest allowed period of them all.

    Seriously, jazzi.jenni, you would be well advised to see if the relative is up for bringing a case against the Supermarkets and getting monetary compensation.

    It IS a breach of the Equality Act (previously DDA):

    What I would do is send a strong letter of complaint to the Head Office (CEO is best) of each Supermarket, enclosing a printout of the attached article. Point out that it was the relative's legal right to be allowed 'reasonable adjustments' under the Equality Act (DDA as was) and that it is patently obvious that longer parking time is eminently reasonable.

    Say you look forward to receiving confirmation that:

    - the fake tickets have been cancelled (call them fake tickets deliberately)

    - steps are being taken to ensure Equality Act compliance immediately

    If not confirmed within 7 days, or if your relative receives any letters about these bogus PCNs you will help them to report the matter to the press, the authorities and to their Solicitor with a view to bringing a case for compensation.

    Someone needs to take action about this scam soon. Supermarkets and PPCs are breaking the Equality Act and no-one has brought a legal case about it...yet. Monetary compensation is the remedy for an Equality Act breach and this is IMHO a sure-fire case of disability discrimination.

    Thank you so much for this reply! this is extremely encouraging and will be passing the info onto the relative involved. I will be wording a strongly worded letter to the supermarket chain also. Even though she got two tickets from different PPC's they were all in the same supermarket car park, so I will be sending both copies to the highest man.

    From having received a ParkingEye PCN myself with TODAY'S post (issued 30/06/11) and being a veteran of these tickets as well as CP Plus, you have nothing to fear, you owe them nothing, their demands are illegal and best of all, they don't do much beyond send one or two reminders.
