That really only applies to credit betting, the way online betting sites operate now is you deposit money with them to bet with. You can use a debit or credit card.0 -
Okay, some people need some clarifications here but no-one has really helped, to be honest, in what to do.
Think it's because I need to clear a few things up...
The overdrawn balance of £2,000 and odd pounds is with my Bank, the betting site is only involved because the money was deposited from my debit card with the bank to this company and then played in the casino. I thought I made this rather clear.
Reporting the fraud to the bank - YES I have done this. But they have liaised with the company involved and they say the transactions were genuine and NOT fraud, because they were done on my account and I'm responsible for my own account details and security, according to their Ts and Cs and a load of blahhhh !!!!!!!!...
So the same situation as if your child used your card on their PS3 account for some reason, it's your responsibily and you'll have to pay up. Well like that, only I've no idea what's going on because I'm 99% certain the transaction was never made at all (hence not really fraud?) but a system error. Some kind of blip that just 'did it'.. I don't know. But I'd look pretty damn stupid saying "oh I think your system just screwed up and debited by card" If I knew, I'd know. But take things as they are.. This isn't really the issue/question to be honest. I've reported it and done what I can, even gone down the formal complaints route and they've said no. So that's why I said.. "take it from me. I won't be getting it back!"
How did I go overdrawn? I don't know why they let me but they did. So take it as it is. It's ironic that I come on here for help and people question what happened because it seems hard to believe, I suppose people don't take things at face value and just help people according to what they've said? So I will explain! I made some internet transfers by BACS whilst the internet banking said I was in credit and luckily I got my money back as it worked. As I said, the internet doesn't show your actual exact available balance there and then, is it a few days delayed. So it was showing I have £xxxx available when in reality a large chunk of this had just been authorised to a betting site.. Hence I thought whilst it's there I will give it a go and see if I can get the money BEFORE they take me off me by doing some funds transfers! It worked. I was on my toes for a few days but they eventually went through. As if I'm gonna let them take my own money off me for something I never did...
The police is an option, a feasible one, but if the bank and the company involved say it's legit, and I'm to blame. Then so be it.
They ain't gonna change their minds are they.
So yeah, hopefully I've cleared things up. That's how things have happened.
So back to the original question. There's no question the bank will now be (and are) chasing the overdrawn balance. But I ain't paying it.
What is the next step? As mentioned in the first post, do I just wait for a CCJ to drop on the mat and deal with it that way. My credit record is trashed through the BR anyway. So if I legally have to pay it back, then they can have a few quid a week or whatever the courts tell me to pay. I'm not paying them bigger chunks that I'll miss. If that sounds confusing basically - if I HAVE to pay then I'll HAVE to pay won't I? But they can have it in dribs and drabs so it'll be like it never happened.
That the best option? Pretty sure no-one else would just give £2k to the bank for frigg all!!

I think you need to take it further with the bank and the Gambling site.
If you are saying you did not play £2K.xx then somehow the money was withdrawn from your debit card or recorded to be drawn.
I do remember years ago with H!lifax, they took £10 from someone else's account and paid one of my bills. Luckily I noticed they had not withdrawn the money, went in branch to query it, and we found they had debited someone else. The account name and number were not even similar! It was pure human error! So they took the £10 out of my account and credited it to that person's account.
Banks are not infallible!

I have asked loads of questions in my posts and you haven't answered any of them.
Others on here are showing interest but have no real idea as the do not use theses sites.
What do you want us to do/say as you say you are liable but did not transfer the money. You have contacted the police/betting site and bank , what we can we do.
You have the money, the bank know you have the money so technically they could charge you with fraud/theft. So be careful.0 -

Basically your answering your own question! if your not prepaired to repay the bank, then as you say you have no other option to wait for a CCJ, as you state or go BR again over the 2k, not sure if you can though for such a small amount? The right thing to do would be transfer the money back and avoid the court action and further credit rating damage but thats not what you want to hear is it?0

yes true. When they cloned DH's card, they must have copied his 3 digits too.
just trying to say to OP, if they are adamant it wasn't them, then to go down the FOS route. They investigate and ask the companies to provide evidence of their investigations and transactions that occurred, etc.

No, that would be the right thing to do had I made the transactions.
You don't just give money for nothing. Especially not to banks.0
