Tax expired yesterday, auto fine?

    The thread concerns the automatic fine that gets imposed for not taxing a vehicle, and post 3 refers to that!

    The buying on line days of grace are to do with the offence of not displaying a valid disc (not the offence of not taxing the vehicle which is being discussed here)!

    A quote from the government website, kind of says 14 days grace if your car is kept off the road.

    If you intend to renew your vehicle tax you should do so before your current tax disc expires. However, this isn’t always possible if you are waiting for insurance or getting an MOT for your vehicle.
    You’ll be committing an offence if you use or keep your vehicle on the public road without a current tax disc. If you can’t get a tax disc, you must remove your vehicle off the road.
    You’ll have 14 days to get a tax disc or make a SORN, while your vehicle is off the road.

    Just to add to all the confusion...

    You are actually ok to relicence it within the first month of expiry, but you must request the PO starts it from the beggining of the month following expiry. so expires June 30th tax it in the PO any day in July asking the PO person for the disc to include July i.e. 1st of July.

    You obviously need MOT & Insurance to be valid for the day you are buying the tax, not necesarily from the 1st of July.

    The direct gov website mentions 14 days but actually you have the whole of the month to buy the disc.

    After the first month you could
    • re tax it to start for the following month and await your automatic penalty
    • Phone DVLA and ask to back pay the missing month and hope they don't auto fine you
    • Phone DVLA and lie to them that you did infact declare SORN from the 1st of July and you haven't had your SORN acknowledgement - this carries the risk that if the car was spotted on the highway in July they will hit you with a fine for being on the road whilst SORN.


    None of this entitles you to drive or park on the highway without a tax disc, if seen you could get a failure to display ticket.

    She's not confusing the issue. She was correcting the wrong information given in post #3

    There is a very good reason for this. Some peoples insurance expires either on the same day the tax disc does (or a day or two before). The insurance certificate normally takes a day or two to arrive in the post. Without insurance certificate you can't get a tax disc.

    This thread is discussing the automatic fine for not taxing your car - nothing to do with not displaying a current tax disc!

    Although you could look at post #3 like that, the "grace days" are specifically mentioned in the legislation and do refer to the 5 days if bought online before expiry. The 14 days after expiry are not "grace days" because

    a) They are not referred to as such and...

    b) You cannot drive your car on the road without tax in those days.

    So post #3 need to be corrected or clarified if you prefer.

    If post 3 wasn't referring to grace days at all, which I inferred it to be, then it was THAT post that confusing the issue.
