Hi, I was just wondering if this was the correct procedure or even legal??

I am currently in 2 months arrears with my black horse loan (£556) & today I had a lady from black horse come to my front door to discuss this.

I previously wrote to their collections department to inform them that I would like to set up a payment plan to pay this off, as I could not afford to do so in a lump sum as I am off on maternity leave. I received a letter back saying that this would be possible & to contact them on the number stated in the letter to set this up. I only received the letter last week & have not gotten round to phoning them yet.

I had no previous warning that they would or might even send someone around to my home. Are they allowed to do this??? or should the communication be kept to letters via royal mail??

  • Have you informed them that you will only deal with them via writing? Otherwise why do you think it is illegal for someone to knock on your door?

    Tell them if they knock again to sod off and that you are dealing with it in writing only they are not allowed to come onto your property if you say so as it is trespassing if you state that they are not welcome they must leave !

    And what will that achieve, apart from them probably just passing the debt to a collection agency?

    It could be contrary to the 1997 Harrassment Act.

    If you previously stated that you wish to deal with any debt owed in letter formatt that Company has no legal right to knock on your door

    You're making a big assumption there. Unless the OP has explicitly said they cannot access their property they have the same implied rights as any one on the street / postman to access your property.
