Horrible iPod Battery and Apple won't help

I bought my iPod Touch 4G in XMAS 2010 and have horrid battery life with it. Using it on low brightness and no wifi gives me a few hours use. For example, low brightness and turn wifi on to check twitter for 30 seconds and the battery meter has lowered.
Now, it was at 80% and I went on the app store for 5 minutes and now it's 40%... It's horrid. Low brightness is unreadable, normal brightness and I'd have no battery. But the worst part is Apple says it's fine :@ I have send it in 3 times now and they say it meets their specifications...What are their specifications? If it powers on, it's fine??
I've sent letters but the same reply.. I'm getting ready to keep complaing. The local shop I bought it from (Comet) won't do nothing either even though I have a £50 3 year warrenty
What else is there to do, I have no support on a near unusable device. What else can I do (Currently I have emailed a few of people higher up in apple but no reply).
(Yes, I have tried 4.2.1/4.3 and above/5.0b1 and 2 but it's still horrid.. What is there to do?) ..
Anything I can say or whatever to Apple, I have owned the iPod less than 12 months and still in warrenty yet they treat me like this.. What can I do?

Tell them you have an "intermittent" problem with the unit "hanging" and "powering off" have you been taking it back to an Apple store or to Comets?0

You could try turning off Wi-Fi and see if battery life improves.0

have you taken it into an actual apple store? with proof of purchase within the last 12 months? when people I know have done that with iphones they have swapped the device for a new one (which also renews the 12 months cover...)0

Yes I have, I wanted them to replace it. But they plug it into their fancy Macbooks and say it's fine as they can test it from there.
My apple store is 60 miles out so hard to do again for them to do nothing.0 -
the only thing i can suggest is take it back to Comet and demand a refund as it isnt fit for purpose. Print off the details of the device you have from Apple's site stating battery life etc and explain that yours does not fit this and you want your money back. If i were you i would then go and buy from elsewhere. It seems you have a faulty product, which amazingly Apple do sometimes let slip through the net (i am an apple fanboy, but i know they are not perfect!)
If that doesnt work, I'd be calling consumer direct, as your device is faulty, there's clearly something wrong with the battery...

Unfortunately you would be depending on a big heap of goodwill as batteries are not normally included in the warranty.
Does your expensive warranty have any specific exclusions for "consumables" (which the battery is normally classed as) or batteries? The only thing you could go with is the fact that the battery is not easily replaceable.What is this life if, full of care, we have no time to stand and stare0 -
Can you try to replicate the situation in-store? If it is dropping 40% in 5 minutes (your example of the app store), then a genius bar appointment will be long enough to show them what's actually happening, despite what their Macs say when they plug it in for diagnostics.0

OR if you really want to have fun [EMAIL="steve.jobs@apple.com"]steve.jobs@apple.com[/EMAIL] Mr Jobs is one of teh few that actually picks up his mail himself, you will get one of 3 outcomes - silence, an apology and someone directed to resolve your problem, or most amusing, a personal reply telling you you are on your own - Google Steve Jobs emails for examples aplenty on the web0
