    Did i read right that the solicitor has closed this case for you and you are going solo?.
    If that is the case,you need to tell FOS this so that they only deal with you,if you win and they let the solicitor know,they will want the % for the fee.

    Because we have been so tied up with this we didnt think to look at any other ppi claims we may have. Between us Barclaycard citi card lloyds tsb credit card 2 loans with lloyds and Endeavour finance. 3 of which have been paid up. The only problem we dont know the account numbers. So we are now investigating.

    This is good news,fingers crossed.
    If you phone the banks,you can sometimes get loan numbers from them,you could even go into branch to do this.

    The cards complaints,all you need is the card number.

    Re endeavour,what year did you take this loan out?.

  • Finally received another letter from D4AL.....

    "D4AL does not deny that it recommended PPI to you. However, for the reasons set out in my letter of 27 June 2004, D4AL is unable to consider your complaint [same reasons that Benji 58 received]. The response to your objections to these reasons is set out below.

    Limitation

    You have not stated the precise legal grounds on which your complaint against D4AL is based. However, I think it is likely that it would be based on a claim which is covered by section 2 (for actions founded on tort) or 5 (for actions founded on contract) of the Limitation Act 1980. Copies of these provisions are enclosed with this letter as requested. It is not generally possible to start a legal claim for breach of contract or tort if more than six years have passed for bringing the claim arose. As the PPI to which your complaint relates was sold to you more than six years ago, I do not believe that any claim in contract or tort that you may have against D4AL can now be brought.

    Regulation

    The sale of PPI to you was not governed by any mandatory regulation at the time of sale. As a result, D4AL did not breach any regulation relating to the sale of insurance when it sold you the PPI.

    I hope this letter clarifies for you the reasons why D4AL is unable to consider your complaint. D4AL now considers this matter to be closed.

    Not sure where to go now. I was under the impression that the High Court ruling against Lloyds Group etc (re misselling PPI) was legal grounds enough to base my complaint on but am unsure of my case because it is more than 6 years since the PPI was sold. Don't particularly want to use a firm of solicitors because of their extortionate fees taken from any settlement gained so should I now be speaking with the FOS?

    Any advice would be helpful please.

    Give FOS a ring and ask what you should do now,you may have to go the insurer route.

    Did the solicitor say why the 6 year time barred (assuming this is Limitations Act 1980) does not count?

    I've been told the same from D4AL with gibberish regarding contract and tort sections of the 1980 Act and they consider my case to be closed as I've not given them precise legal grounds for my claim.

    Our claim not with a solicitor anymore On the advice from FOS we have a claim against the underwritter.
    Can I just ask what reason you gave to D4AL for miss-selling?
    We were informed by our solicitor at the time that the time barred rule does not apply.

    In these circumstances our suggestion would be that you approach the entity responsible for the sale of the insurance which in this instance we believe to be Firstplus"
    Back to FOS AGAIN!!!:mad:

    A long time since we updated this, so just to let you know,

    Still with the Fos, had the 2 usual letters one in Jan and March to say due to high volumes of complaints there is a delay.
    Spoke to them in March and asked did we have to wait at back of queue again when the complaint has been going for 3 years and we have done all what they told us and still the same claim number. The person I spoke to sent an email to another department. Told me if not heard anything in 8 weeks I must contact them again.
