Hi just to give you an update on my hopeless case!!!
Spoke to solicitor today was told the following options,
"This is a difficult and complex case due to D4AL not being regulated in 2002.
Although welcome put in there letter 6 year time barred this does not apply. We can wait to see what the ruling is going to be on underwritters but until then we won't get anywhere with them. I will get a second opnion but it looks likeit will have to go to FOS as a new case."
As you can see from my earlier post already been to FOS so that will be another 12 months plus before we get any responce. And that still might not be the one we want.
I can't help getting a bit stressed with it all now0 -
Just spoke to FOS myself I don't have to start a new claim keep my reference number from before he asked we send in reply from D4AL and find out from Firstplus who the underwritter was at first they said Barclays of dublin but when they checked said it was Jubilee. I have never heard of them. Asked them for proof because we never recieved anything. Hi, Jubilee were in fact called Cassidy Davis and they are dealt with by the Society of Lloyds. You need to make your complaint to Jubilee and they will then either uphold it (yeah right!!) or let the complaint be handled by the Society of LLoyds. You would maybe better to let FOS write for you in this case. If you do this alone then you would write that you are holding them responsible for the sale of your PPI as the broker was unregulated at the time. You then have to give them 8 weeks to resolve this and then if they come back with a negative you would take this to FOS.
Also Jubilee may ask that you sign a letter or write a letter to FIrstplus to allow them to handle your file. I am not too sure on this but it has been known.0 -

Heres a little puzzle for you all
Already posted I spoke to First Plus On Thursday and was told it was Jubilee insurance and they would send me a letter to confirm this. But My husband emailed First Plus customer service Thursday night and asked for the name of insurance underwritter. He got a phone call Friday afternoon asking him why he required this information and was then informed it was Barclays of Dublin and stated there was no documentation available except the small booklet we recieved at the time of the loan. They will send out a letter to confirm it was Barclays of Dublin.
So to sum up we now are waiting for 2 letters to arrive from First Plus one saying it was Jubilee insurance and one saying Barclays of Dublin0 -

Solicitors wrote to D4AL to ask for final responce because letter they sent did not say final responce and fos information in letter was incorrect. They sent letter to D4AL on the 11th. Spoke to welcome (D4AL) on 19th they say letter not on file they still have not recieved it. I will be contacting them again today.
Welcome have been given until the middle of next month to respond then its onto the Fos.
When I spoke to solicitor they didnt know we could use the same claim number we had with the fos 12 months ago.
Fingers crossed Welcome tell me they have got letter on file when I speak to them later.0 -

Welcome fax number customer service 0115 9849 302 I was told all faxes are scanned and put on to your file within 72 hours. Hope this helps someone.

Sent everything to FOS with a covering letter and we can still use the same claim number from 12 months ago. Had a responce from FOS they have wrote to 'The Society of Lloyds' and we should have a final responce in 8 weeks, if we dont agree FOS will look at complaint again.
HELP - The questionaire we have to return not sure what to write why we think they are responsible, because all the other questionaires we have quoted the telephone conversation with first plus 'we would have money for our daughters wedding and education, etc' If we write the same again would Lloyds say first plus are at faulf?

:I refer to your letter dated October 2010 which set out your compliant
The purpose of this letter is to explain reason why Dial 4 a loan (welcome) is unable to consider this claim.
1. Complaint relates to sale June 2002. D4AL arranged a loan from first plus.D4AL also recommended a single premium PPI policy, and the premium was paid by adding it to the loan D4AL arranged. First plus sent the funds to pay for the insurance premium to an insurance company of their choice.
You may want to consider whether you have a right to complain to first plus or the insurance company who provide the ppi.
2. As a general rule D4AL can only consider complaints of misselling if they are made within six years of the date of sale. Therefore your complaint could not be considered in any event unless there is legally valid reason why the six year limitation period does not apply in this case.
3. I have considered whether you have the right to refer complaint to the FOS who normally consider complaints that relate to FSA regulated activities. Unfortunately your claim relates to a sale of ppi June 2002, prior to the 14 January 2005 sales of insurance by brokers were not regulated by the FSA. Consequently I do not believe that you have the right to refer complaint to the FOS.
I realise that my conclusion that D4AL is unable to consider your complaint will come as a disappointment. I hope this letter is helpful in explaining why D4AL is unable to consider your complaint.:

I am in the same boat with D4AL. Loan taken out in April 2003 and paid off in full in 2004. The (only) letter I have received from D4AL Limited (c/o Welcome Finance) is worded exactly the same as yours except mine says that "D4AL arranged a loan for you from Welcome Financial Services."
Seems they are just sending out a blanket identical letter. I responded to this letter immediately and have not heard a thing since.
I'm in the process of writing back to them again tonight..........0 -

You put the reasons you think they are responsible as.... there was not enough information regarding the true cost of this ppi, had you known the insurance was a loan upon a loan that you had to pay interest to term end on, but that the insurance only covered you for a few years,but was still on the loan to term end with interest,and you had no cover from that point.
You think that Lloyds did not make clear to you the impact of this costly ppi in the literature to enable you to make an informed decision.
Did i read right that the solicitor has closed this case for you and you are going solo?.
If that is the case,you need to tell FOS this so that they only deal with you,if you win and they let the solicitor know,they will want the % for the fee.0 -

Good luck we are waiting to hear from Lloyds of London they have got until the middle of November to give final response-then back to FOS0
