No, I'm not having a laugh. The OP has asked for advice and you, in your wisdom, have read into that, something which is not there to read.

My advice to the OP is to walk everywhere.

What's your perceived wisdom in this 'case'

Am I liable when somebody puts an obstruction in place that is not clearly visible?
    Damian.

    In this case, yes.

If it was (say) a skip that had, under statutory regulations to be lit, then it would be no.

But reversing into an object is down to you.

I drove into a boulder in a car park in May.

Well actually I kind of caught it a glancing blow...surprised it probably. It didn't flinch, though. Instead it kind of used the power of my glancing blow against me a bit like a martial artist - must have moved so fast I didn't see it, but it tore off a chunk of my back bumper leaving the inset lamps hanging out. Had to patch myself up with gaffer tape, before I limped back to Dunkirk and blighty! No sign of any cup to redeem the situation either:(

Boulder chummy's still there, bould as brass in fact, with it's mates. Damned häßlicher Flußstein of a character!

    It's at 51°31'11.03"N, 7°27'33.98"E

(the silver car at an angle is quite rightly approaching warily the suspect häßlicher Flußsteine on it's nose ...)

And the name of the street? Well, I can hardly complain can I? Steinstraße...doh!
  • I have thanked OP for the highly amusing post. We should have more comedy questions posted!
  • He's not been back since - I wonder why

Let's hope that if you have a car, and you encounter a similar incident which potentially could leave you several hundreds of pounds poorer, that you will still regard the experience with such amusement?

Well, if you want to be serious about it I think the amusement lies not so much in the accident but in the question of whether someone else was liable. In the past I did have the misfortune to drive into a stone post which was an expensive mistake (and I was a poor student at the time). It was certainly not funny. However, I freely admit that the incident was down to poor driving on my part - how could it not be?

I think if I had tried to sue the landowner for the actions / placement of his stone post then I might well have seen the humour (stupidity?) in that.

    Happy?

I reversed into a lamp post last year.

I tried to sue it, but the case went nowhere...

Has anyone else ever reversed or side swiped those stupid posts which are about 2' 6 high and rough pebbley stuff in car parks. You know the ones that jump out and get your side door - lower than mirrors, and windows. They really make a nasty crunching sound, as your door caves in.:o

Its sounds like the poster was somewhere between a rock and a hard place;)
