Egg loan being sold and my ppi claim
Comments
-
I followed the template on this website and sent requests to Egg for my terms and conditions and details of any PPI along with a cheque for £1. I have one of the loan numbers so I thought it would have been straight forward...
They have sent a letter back saying:
"As the account you refer to is now closed I have to inform you that EGG are under no obligations to comply with a request for a copy of the executed agreement under the consumer credit act as we no longer have a contractual relationship relating to this account, nor are we seeking to enforce any agreement on the account.
The right to be provided with this information from Egg Banking PLC ended with the closure of the account.
Section 77 (3) (a) of the Consumer Credit Act states that section 77 (1) does not apply where 'no sums, or will or may become, payable by the debtor'. The right to request an executed copy of an agreement is found in part vi of the act, which is entitled 'matters arising during currency of credit or higher agreements' so where an agreement is no longer current the right to request or be provided with a copy of the executed agreement therefore ceases."
I KNOW I was mis-sold PPI for various loans as I remember them saying that they couldn't give me a loan unless I took out at least 2 of the 3 options and I was self-employed at the time. But are they trying to fob me off with this drivel and what the hell do I do now?!

Further to my letter from egg, I have a similar one from barclaycard quoting the same blurb about section 78 saying that "... as no sum is or will become payable under the credit agreement we are no obliged to provide you with the documents and information you seek."
I have a letter from Egg stating with reference to my PPI as I cancelled it just before I paid off the loan as I realised that because I was self employed I couldn't claim anyway...
What now?! I know they owe me, I have written evidence of PPIs just not ALL the paperwork for ALL loans...
Is anyone else finding it this hard? I won't give up though!!:mad:0 -
If this loan was settled with the second loan then they should find this if you put a claim in.The other one Im not sure whether it was more than 10 years ago... I can't claim for that though can I? But I haven't got the whole paperwork for that one so don't have a breakdown.
The first one looks like it was single premium, a loan on the loan that you paid to term with interest.use this as a reason for mis sell.
If you have both of the account numbers ( if you only have one then tell them to look at the other one you had)just go ahead and put the claim in to Egg.
Look here for other reasons for mis sell too.

Ive tried so much with them, sent the £1 request and then the £10 one, which they cashed and sent a reply saying they still weren't going to help because the account is closed!
Its with the ombudsman now... good luck!0
