As far as I am aware, there are no waivers to the DPA for finance companies to use, even if there were, the people named on the list would not have been able to have signed it.

Why would the references be required to sign any forms relating to DPA? It is the OP's details so only he/she would need to give authorisation for BH to discuss their information.

Also, can you point out which specifics of the legislations you believe BH have breached?

    From their website...
    2. Do I have to provide personal references?

References may be required. If this is the case we ask you to supply the names and telephone numbers of 2 character references all at different addresses who we can contact to confirm the details we have on your application are correct. A member of BrightHouse store staff will contact your references over the phone. The references are not guarantors and require no signature.
They are under no obligation and can refuse to provide a reference.
    I'll offer no comment.
Just wait for Flyboy to pick it apart. :rotfl:

    OlliesDad, pleas don't ask questions.

Flyboy doesn't like answering them. ;)

The fact that they have been calling these "references" to ask where their customer is. Now, that will give you a clue, if it doesn't, it is not my fault you don't understand it.

The legal definition of harassment is: behaviour likely to cause alarm and distress.

That does not give Brighthouse permission to call them to ask where their customer is. They have specified that the only use the names are put to are for "reference" and nothing more. There is no relevance to the customer's payment history. What does the DPA say about the use of data which is "relevant and appropriate?"

I will point out the statement from the site that you kindly used earlier:
Remember the prime aim is to help provide info and resources
I do not see how you feel that using the fallacious argument of "i know the law exists and if you don't you are stupid" is going to help the OP resolve the situation as you provide basic info and no resources. I cant imagine that the customer will feel comfortable going into BH saying "Flyboy says it is illegal, but he wont tell me why".

Also that explanation of harassment is too simplified, and even in the form you have provided i do not see that BH can be accused of that on the basic facts given by the OP.

I have said this before and no one has ever been able to answer: do people really look at the title of this website and ever consider the purpose behind this forum?

    A little reminder for you:

Well I believe that I offered advice,in the manner that there are options to stop this happening again!
However this is a PUBLIC forum and unfortunately when you post you have to take the risk of people expressing their opinions. Unless people are being "offensive, racist or libellous" you have no recourse just because you dont agree with what is said in a post!
In a perfect world of course you would post in a forum and recive 50 replies all sympathising and telling you how right you are. But this is far from a perfect world!
I may of been blunt but basically if the op is truly upset by Bright Houses business practices (which incidently would of been made clear from the beginning) then as I said previously, he could always return the item and cancel the contract (this is allowed and is an option). Or if he is likely to miss a payment again, then he could alway simply contact them first before being chased, or ask someone to call them and explain. They only call the contacts (and Im not really interested if your opinion is this is wrong/illegal) when they cant contact you, so why not contact them first? Or pay a small amount extra to cover the possibility of a missed week.
I have been a BrightHouse customer before so I know how it works.
Ideas, help and advice always welcome, judgements and assumptions are not!!

    More questions ...eh Flyboy.

To use a hackneyed phrase... "how does that help the OP?"

It's information people are looking for, not more questions. :rotfl:

Then I suggest that posters restrict themselves to that specific activity, rather than making unwelcome moral judgements.

I'm confused how Brighthouse have managed to contact a member of your family who wasn't named on your contract.
    Flyboy152 wrote: »
Presumably because they had family members on their database, because they had been customers of this finance company.

Flyboy, I'd rather hear the answer from the OP than an assumption from you.
How would Brighthouse know from their database that say, !!!!!! Smith from xxx village was related to John Doe from yyy village?

Spooky, any chance of an answer to my question above?
    Thanks
