    I'm sorry, but on the basis that you've been suing a solicitor for 4 years and your EA friend has not suggested that you investigate the Survey Report to ascertain if it was actually the surveyor at fault, would lead me to the conclusion that their opinion may not be worth much. Apologies for being so blunt.

    Are you paying your solicitor (the second one I mean) or are they no win - no fee? Because I suspect that for the price of 90 mins of solicitor time you could get a local surveyor round to your flat to inspect the property, assess the issues with building regs, look at the survey report to assess if the first surveyor was negligent and also tell you if the indemnity policy will push the value of the flat back up to what it should be, and provide you with a report detailing their conclusions.

    I would have thought the above is something that should have happened 4 years ago.

    It's a longshot, but...

    Hang on - could you luck out here and find out that the bank basically didn't handle your mortgage application correctly in someway as a result of the incorrect assessment of the property - and get the WHOLE debt written off?

    Goodness that would be AMAZING! I called the bank on Friday and I need to put it all in writing. I am a little cautious about this though as am worried it could work the other way and they make me re-mortgage the property and I end up worse off!
