With the descriptions, I am always super cynical - I see so many end of terraces advertised as "cottages" for example and so many 4-bed houses where the fourth bedroom is the dining room. In my understanding a masionette is flat/apartment ; but just one of two levels rather than a block, normally with it's own door (call me out if I have got it wrong!) so I would consider the descriptions just semantics.
What did your survey say about the loft room? How did your buyer work out it didn't conform to building regs? I think my main concern if I'm really honest is that this has been going on for 4 years and am wondering why my solicitor has allowed it to drag on so long.
I know this may sound very controversial and perhaps a little silly but I seriously wonder if the fact the 2 solicitors involved are located on the same street has anything to do with why I feel I have been fobbed off for so long. Please can someone reassure me I am wrong!0 -
I'm sure someone will correct me if I'm wrong, but the way I understand it is that as long as the loft conversion conformed with building regs when the work was carried out, then there shouldn't be a problem.
This is the same the huge numbers of houses with older double glazed windows that don't conform to current regulations. If new windows were fitted, then they must conform, but they can't make you change the old ones.0 -

The buyer found out when he had his survey done, he was equally as devastated as he really wanted to buy the property but couldn't get a mortgage as the property did not value-up. I couldn't sell as a one bed as the difference was £25k.0 -

Yep that is true and I was going to apply for a Lawful Development Certificate for an Existing use or operation in breach of a planning condition.
However, this does still not allow a purchaser or myself to value the property as 2 bed, rather a 1 bed with a loft room, leaving me in the same situation I am in now.0 -
