Won my ESA appeal, What happens with backdated money?

    Hi,
    A friend of mine just passed his appeal, after over a year on the assessment rate. After reading this thread, I understand he will be reimbursed the difference he should have been paid if he was awarded ESA at his original medical. Here's my question. During the severe Winter he was on the reduced rate, he racked up debts with his fuel provider. People on ESA at this time, got at least 3/4 cold weather payments. He should have been entitled to these also. Will he get them, now?

    As you have no doubt found out by now, you will get the £250 a fortnight in arrears for 13 months, and you will continue to get 394 a fortnight.
    the only good thing is ive been told no more medicals for 2 years and maybe not after that either
    You need to phone ESA to ask how long till you will be re-assessed. it may not be 2 years, it could be 1 year if they want to. You WILL be re-assessed, everyone on ESA is constantly re-assessed.

    Only if he got ESA IR at the time and only if the WRAG/SG is applied to his claim at the cold times.... CWP not payable on ESA C.
  • Patience is a virtue :-) Hubbys appeal was lodged Dec 2011,tribunal 16th Jan 2013 !!! Won and put in support group and recieved backdated payment of just over 2 and half grand within 6 weeks.

    Mine took a week from my appeal hearing to the money in the bank.I won the 18 Sept and was in the bank 25th.

    Why was mine so damn quick i cannot tell you, a friend has been waiting since he won his appeal in August, for his backdated money.(same appeal building)

    If they can do mine in a week, why can't they do others?

    Hello, im trying to help a friend out as the system is annoyingly hard to try and understand so i offered to try and help, he is now married with 1 child

    He was awarded 'contributions based ESA' for around a year (he was previously on incapacity benefit)

    Now they have said his contributions have been used up and they also said he was no longer allowed the money after his medical

    He appealed the medical and the tribunal found in his favour

    Now the ESA have accepted the decision but say he is no longer allowed ESA as his wife is getting income support and they cant not claim both

    Can he claim 'income based' ESA

    Now their child is 2 his wife wants to go back to work but then they will have to pay all of the rent, child care (as my friend can not look after his child due to his disability and has been told he is not allowed to work)

    He can also not apply for job seekers allowance as he is never allowed to work due to his fits (at stressful times 8 a day)

    What can they do?

    I can answer any questions you people might need

    Should have started a new thread...

    She is on Income Support because she cares for him and gets Carers Allowance.

    He cannot claim ESA IR while she claims Income Support.
    He will get his NI credits paid on ESA

    If she stops IS he can claim ESA IR but overall there may be little increase in the amount they get and possibly the amount they get together could go down (more likely to go down) but we would need to know what rate DLA care he gets middle or high? and if she gets DLA care aswell?

    Since this thread is here I may as well ask myself as won DLA back in February and took about 5 weeks to get backdated.

    I won my ESA appeal last Tuesday and assume its the same, only real query on that is does the extra start straight away and just the backdating take a while to sort out or do I get paid at the assessment rate then when the backdating up to date of when they get it sorted occur?

    Your friend should at least phone to check that DWP knows they have won their appeal otherwise they are waiting for nothing.

    The arrears & uprating will occur at the same time. You should also phone at the end of this week to be sure they know you have won your apeal otherwise you will be waiting for nothing.
