Won my ESA appeal, What happens with backdated money?

  • I won my appeal on 13th Nov, and having read all the posts on this subject I decided to call the jobcentreplus today (on an 0845 number which really annoys me!). I got a very short sharp response initially, saying it would take up to 8 weeks for them to process. This was before I had even given them my details!! I then asked if there was any way they could check to see if they had had the tribunals decision and was told abruptly 'just a minute'! After taking my details with all the enthusiasm of a wet weekend, I was told that they had not received anything to sya that I had won the appeal and there was nothing I could do about it except what for them to receive the decision from the tribunal!! Charming! I wouldn't mind but I am on ESA after suffering a violent armed robbery at my place of work in August 2012, and this just adds insult to injury!
    Does anyone know if taking my papers from the tribunal in to the jobcenterplus will actually make any difference??

    After reading this thread you should have asked him for an appointment at your local jobcentre to have your win notice emailed over. Phone back ESA and ask for an appointment at JC to do this.

    Taking them to a jobcentre without an apointment will usually result in the jobcentre sending it by post/courier to the ESA office and that can take about 5 - 6 working days to arrive. If you let them do this ask them to send a photocopy not the original.

    Jobcentres are able to book their own appointments for customers who walk in off the street, but most of them refuse to do so, and tell you to phone your benefit line to get an appointment. Ideally people should make a formal complaint to any jobcentre staff that refuses to book their own appointments using their own computers.
  • Thanks for the advise. I did actually ask if there was anything I could do, like bringing in my Tribunal letter, and was told that I just had to wait for them to receive their copy! I also complained about having to call their 0845 number from my mobile (can't afford a land line), and was told that I could go to my local jobcentreplus and use a phone there.....ummm...that will cost me £4.30 in bus fare!!
  • Im so sorry for latching on to someone elses post, but cant for the life of me work out how to do my own thread , ( if thats what it is called) please move me if it is possible.I was on income support, with a disability premium, and after atos assessment they recommended me for support group on 10th september.I recieved a letter from dwp 6 weeks later to imform me that i would be recieving esa , starting 5 weeks later, so a total of 11 weeks from atos decision.I recieved first payment today of eesa ( whatever the 2 es mean).I have just got off the phone from a really lovely lady at dwp,whom i phoned to find out when i would get the backdated payment , back to atos decision on 10th september, as it is £21 a week more then i was getting , and she told me there is no backdated money. Is this correct? It dosnt seem fair that dwp can take 11 weeks to start a benefit that make the claimant financially better off, but not rebate for that period of time.And it is my belief that if someone loses their medical , and then appeals and wins, they get backdated to when atos made the assessment, not when dwp made the decision . Sorry if this is jumbled, im still teaching my self computer literacy.

  • Thankyou for replying to my query, and explaining how to have my own thread, but copy and paste is totally beyond my capabilities im afraid.I have tried and tried to do it, but it just dont work lol.

    There's no point complaining to DWP about 0845, you you should make that complaint to your MP and Ian Duncan Smith.
    You can always ask ESA to phone you back but you have to pay while waiting in the queue to get to that point.

    So .... did you now have it emailed from a jobcentre?

    Alternatively you could take a photocopy of your letter and send your original recorded delivery but it will take 5 days to be processed. Keep your recorded delivery receipt incase the DWPs middlemen lose it.
