Can I ask please, OH does not want to work for this dept any more, due to not only this, but the general appalling way staff are treated, and the dreadful management culture but feels he must try to 'clear' his name (of dismissal at least), and go to appeal, and if not sucessful, tribunal.
This is going to be very stressful all round - I work in similar area, we have common friends and colleagues, I am finding it difficut to cope, let alone being able to support him, and not entirley sure I am thinking rationally.
Should we persue this, or just accept and get on ?0 -
you can always go ahead with it but not return there if successful in clearing his name.
What you need to ask yourself is can YOU cope with it.

thanks, yes we will i think certainly do the appeal, while I think OH was a massive fool in what he did, I don't think it justified being sacked (tho some on here obviously think it does) and the sense of injustice would gnaw away at me and be very distructive. Whether I could cope with supporting him through ET is another matter, although I am usually mentally stong, this year has been a terrible one for a number of reasons, ths was the final straw really, as within the space of a couple of days my life has crashed around me, and from now on things will be very different.0

I have a job, thanks. I am not sticking the knife in, I am angry that his employer has chosen to dismiss when there is plenty of precident for a lesser penalty - i know he was it was a stupid thing to do, but the consultants report said that this sort of behaviouris a classic sign of someone who is not coping.

Yes there is - it has already been suggested that this might be a factor, but I dont think it entitles them to dismiss someone illegally - sack for an offence that within their own rules is not sackable.
The irony is that this will cause them massive problems, he was not a waster (even tho it would seem so, ie the time on internet thing, he actually did so much work to very high quality and tight deadlines) so cannot see why they have taken this line whene there were alternatives.0 -

Some good (if you can call it that) news regarding this. Union rep has confirmed this morning that there are no precidents in Dept A for anyone to be dismissed for this offence, it is a 1 year warning letter. Also, under Innaproprate Use Guidance, they are obliged to tell employee immdiately when a breach is found, which they did not, he was told months later. the Rep has the (anonomised) cases of those that have been sacked, all were for viewing hard-core !!!!!! on illegal sites, which is not what OH was doing (for those that queried this, it seems this is the process, both sides have access)
Shows the level of incompetance, they have sent a pension letter, he has not had dismissal letter yet. He asked for all corres to go via union, they have sent it to home.
Union have aggreed I can go to the next meeting, so that will put paid to any consiracy therories that OH has not been anything but honest.0 -
forgot to say, the investigation looked at innapropriate usage before and after the allegation period, and no misues was found, evven though OH wnothing of investigation, so does show that this was a temporary abberation I think.0

yes the two pics were the sort of thing i have seen on the wall in the garage - not just topless, FF, but nothing that most men (in my experience) would have seen by the age of 14.
if the Depts concerned had sacked everyone that accessed '!!!!!!', they would be looking for staff, not losing them - there are degrees of '!!!!!!' and this sanction is only used for the extreme end of the spectrum (bestiality for example). viewing what i would call hard-core is deemed to be gross misconduct, but again does not get a dismissal.0
