You see, your issue here is that you think it is a fact that it is gross misconduct. It is an opinion. It is not illegal to view !!!!!! or to pick your nose at home. So you do need to get the brain out of the box and justify it as an opinion rather than bowl along as though it were a fact.
But the thing I think you should find most disturbing is that even if your view is upheld by employers now, it won't be upheld as soon as there is a healthy employment market. In other words, gratified though you might be at a sacking in this case, the employers will not whole heartedly support the moral position, rather. they will use it as a pretext.
I am not gratified in any way that someone's habit has had this devastating outcome and it says more about you than me that you think this. It's not the moral position bad though that is but the legal position that you should not access !!!!!! at work. I and many others think that at work you shoud not use the internet for your own needs.Lost my soulmate so life is empty.
I can bear pain myself, he said softly, but I couldna bear yours. That would take more strength than I have -

SarEl has made the point that if the employer dismissed for accessing !!!!!!, the ET would be unlikely to overturn this. That is not the same as saying that the legal position is that you should not access !!!!!! at work. Indeed if the employer were the publisher of certain national newspapers, it would be hypocrisy to dismiss for this reason!

I don't thinks anyone here has said it is acceptable - what is at question is the penalty for doing it and getting caught.
what my OH did was totally stupid and unacceptable BUT does that mean he should lose his job of 32 years? he was not viewing hard core !!!!!!, it was not videos, it was for a couple of minutes on two occasions during a period where he was obviously in a bad place mentally. He is not a waster, has worked really hard for years, never took time off sick and has consistently been a high performer. if everyone who had done the same as him had been sacked, fine i would accept that he paid the fair price for his stupidity but this is not the case.0 -

and if in every case looked at indiviually, the result has not been a sacking apart from this one, is it not reasonable to ask why? otherwise how are we supposed to ensure that there is not something else at play, or that the panel did not just have a bad lunch?0
