So let me get this straight, you signed for a contract with no data, set up data services which AREN'T SET UP BY DEFAULT like iPhones/Blackberrys and now are complaining about charges. Did you specify to the salesman you wanted to use the internet or assume that he knew this by the nature of the style of phone? This phone is not a smart phone even though it los like one. I sold hundreds over Christmas and I know for a fact they do not charge for data automatically, you have to set those functions up.

Again, there is no such thing as a local call boost. Did you read the contract?

He knew we I was going to use it for e-mail that's why I decided to buy it! We discussed this explicitly, I even mentioned my concern of a data limit!

The phones has apps, an internet browser, e-mail, integrated twitter, integrated facebook, unlike the salesman pretty smart I would say.

Would you sell this phone knowing it's intended use and not make sure the internet booster was applied.

The contract does not mention any data charges.

I take it you work for CPW

We are not worse. We are just realistic, unlike you.
You can waste your time and money on court actions if you wish, but IMO you are unlikely to win.

    Why would I not win?

I am ex employee of a large mobile phone retailer. This phone is not a smart phone, just has internet capabilities. Why would you have set up email without internet on your tariff? I would have thought this was obvious?

Also, yes I sold this phone without internet boosters many a time and had no issues as most customers realize that if they use the internet on the phone, they will be charged for it. Most (TRUE) smart phones I sold came with an mandatory data bolt on, again the Nokia C3 is not a true smart phone.

The term for the phone is irrelevant, it's function is as a phone and as an internet connected device, anyone can see that.

I expected my contract to cover the use of the intrinsic functions just as my friends with iPhones enjoy.

And the fact is I COULD have done so if only the salesman had done his job correctly, I wouldn't mind some back up on this rather constant aggression and denial of what is so obvious.

Because you cannot prove that you were missold.

It's not a term for the phone. A true smart phone will connect to the internet by default, you have to turn it off. A phone which isn't smart but has internet capabilities (like the C3) has internet turned OFF by default and you have to switch it on.

I find it hard to believe that you told the salesman you wanted to use the internet and he didn't add on a free booster. And then you happily signed a contract which didn't say anything about a data allowance on it even though you'd told the salesman that's what you wanted the phone for?

Even if he had made a mistake, this could have been resolved by you reading the legally binding document which tied you into a lengthy contract before you signed it.

Why would a judge or anyone else believe I willingly chose to not include the internet booster and opt for huge data charges on device such as this.

As I have said the contract makes no mention of data charges.

This phone checks my e-mail and Facebook around every 30 seconds that may not be a constant connection but is not a case of me "switching it on" and to use the functions in the fullest requires good amounts of internet usage.

Whether you believe it or not we discussed my internet usage, I even asked him about using it with my laptop for internet and he said "tethering" is not officially okayed but "may" (hint hint) work. I really can't see the point of this phone if it's not for smartphone style features, he knew my usage for the phone and I think made a mistake and is now trying to cover for that mistake.

I'll ask again, did you read the contract?

I've answered that 3 times, it doesn't mention data charges!
