    I think you'll find the tenant still alive is still responsible for the rent. He/ she will also still have rights unless they give notice. Will be entitled to continue to rent the property.

    Just noticed you're in Aberdeen too. So it's Scottish law. Hadn't spotted that before.

    This one is English Law.
    Mr Allen, 66, appeared at Crawley Magistrates’ Court on Monday dressed in a beige polo shirt charged with the murder of his wife, Linda, on Thursday at their rented home in Nyetimber Lane, West Chiltington.
    Police believe that Mr Allen became obsessed with the possibility that the project to renovate their nearby home in Nyetimber Copse would fail and that the pressures of the project had been getting on top of him. Mr Allen is accused of attacking his wife with a hammer in an upstairs bedroom, striking her five times over the head.

    Could do...Housing Benefit is still payable whilst the defendant is unconvicted. A standing order may have been set up to pay the rent. As soon as it's in arrears I'd get the ball rolling on the notice to quit.

    I resent the posts which suggest im callous!!! This is a MSE site not a forum to get my sadness out there.

    I have been affected greatly by the whole situation and my initial thoughts were with the deceased and the kids!!! All I want to do is the right thing! Hence why I posted the business part of my responsibilities on the MSE website.

    I will and have paid my respects more personally than on an internet forum so I suggest the people who think that \im callous have a reality check of what this forum is here for~!!!!!

    For the record I had all relevant certificates and everything was legal. No corners were cut!
  • I don't think it's at all selfish to ask for advice in such an unusual situation. It must have come as a huge shock.

    Anyway, don't tenants have a responsibility to actually live in the property and not abandon it? If the guy is imprisoned, or even just on remand for ages, then even if he does pay the rent it would still seem reasonable to end the contract.
