    You are responsible for ensuring that payments are made on time. If you do not receive notification that the DD has been set up, either by letter or by checking your account, you should continue to make payments by other means. As you have not done this, the LA have taken the correct steps to enforce your liabilities. I don't see the problem.

    Hands up everyone who checks their bank statement each month for entries that are NOT on it!
    I look at mine and note the three figure sum each month muttering "I wonder what I get for that" - bins emptied once a month?

    But would I notice that the council tax had not been collected ? Probably not?

    I might have received the reminder because the council tax collection department of my local council is the one department that manages to use my correct postal address.

    The problem seems to be that the original poster failed to realise that the monthly payments were set up as a concession in the first place (as council tax increased as a proportion of national income) and perhaps failed to react promptly to correct the communication failure with the council or perhaps did not project a willingness to help sort it out..
    If the original poster really feels aggrieved, find a sympathetic councillor, complain to the local authority ombudsman, refuse to pay the 35 quid charge (and risk it turning into 70 quid or more if it goes to court.

    what you all seem to be missing is that it was a mistake that it hasnt been paid, but for them to say ive to pay £35 for missing 2 months is a disgrace!!! I have never said that I am not going to pay my CT infact the 3 months will be paid next week (junes will be then early) but the £35 will never be paid and anyone who thinks its ok for the council to charge £35 is just nuts if you ask me
    Have they sent you a notice cancelling your right to pay in instalments yet?

    I can't be the only one.
    If my council tax wasn't collected I would notice almost immediately as my available balance would be £138 higher than expected.

    If you are ever "summonsed to court" for council tax
    When you get to the court, ASK whom is sitting here upon the oath as a magistrate in this room.
    You will get some funny looks, but it soon becomes apparent that you are in fact sitting in a room hired by the council at the court and there is no magistrate present and only speaking with council employees, the whole thing is a scam.
    You might as well be sat in the boiler room at the sports centre talking to the cleaners.
    I Ask this very question, I stood up in the court room and approached the 3 people sitting writing on the bench and asked, who is sitting in this room as a magistrate, the refused to answer, so I shouted, if any magistrate is present in this court room please make themselves known to the court. A old gentleman came over and said, they are not magistrates, they are just council employees, "WHAT I replied, well shouted , then why am I in a court room with 3 people sitting behind the magistrates desk pretending to be magistrates desk ?
    An Usher asked me to leave "the court".
    I attended the desk and complained that the Magistrates had failed to identify themselves, then I was told... That the council hire the room to arrange council tax payments from the court, So said I I have been billed £28 for a court summons that is not a court, by the court, can I lodge an appeal please, wait here she said, she came back and said thats been a mistake, the charge has been cancelled.
    So I rumbled them, no magistrates = no court
    apparently it is a huge scam, they apply for a liability order in your absence from a real magistrate in a REAL court once you have left.
    Dont fall for it.
    I never heard a dickie bird from them again, no liability order, nothing.
    Anyone else ever been summonsed to one of these "FAKE courts"
    I bet most don't even cotton on.
